Ex-Trump Fundraiser Broidy’s Conspiracy Suit Tossed by Judge

Elliott Broidy, a former top fundraiser for the Republican National Committee, can’t sue a former U.N. official he claims was part of a Qatar-sponsored conspiracy to smear him in retaliation for his criticism of the Middle Eastern nation.

Broidy, who raised funds for Donald Trump and runs Los Angeles-based Broidy Capital Management, resigned as deputy finance chairman of the Republican National Committee in April when it became public that he’d agreed to pay $1.6 million to a former Playboy model to keep her quiet about their affair. The agreement was negotiated by Michael Cohen, Trump’s longtime lawyer and fixer, who was sentenced to three years in prison Dec. 12 for crimes unrelated to Broidy.

Broidy sued Jamal Benomar in July, claiming he was part of a plot by Qatar to hack his computers and leak his emails, allegedly to punish him for using his relationship with Trump to influence U.S. policy against Qatar and in favor of its gulf rival, the United Arab Emirates.

U.S. District Judge Cathy Seibel threw the case out on Friday, in a hearing in White Plains, New York, ruling her court lacks jurisdiction over it. Benomar had argued that, as a diplomat, he is immune from the suit.

A sitting president talking to his attorney general about investigations where he is a potential target. :?

Trump lashed out at Whitaker after explosive Cohen revelations

https://www.cnn.com/2018/12/21/politics ... term=image
President Donald Trump has at least twice in the past few weeks vented to his acting attorney general, angered by federal prosecutors who referenced the President's actions in crimes his former lawyer Michael Cohen pleaded guilty to, according to multiple sources familiar with the matter.

Trump was frustrated, the sources said, that prosecutors Matt Whitaker oversees filed charges that made Trump look bad. None of the sources suggested that the President directed Whitaker to stop the investigation, but rather lashed out at what he felt was an unfair situation.

The first known instance took place when Trump made his displeasure clear to acting attorney general Matt Whitaker after Cohen pleaded guilty November 29 to lying to Congress about a proposed Trump Tower project in Moscow. Whitaker had only been on the job a few weeks following Trump's firing of Jeff Sessions.

Over a week later, Trump again voiced his anger at Whitaker after prosecutors in Manhattan officially implicated the President in a hush-money scheme to buy the silence of women around the 2016 campaign -- something Trump fiercely maintains isn't an illegal campaign contribution. Pointing to articles he said supported his position, Trump pressed Whitaker on why more wasn't being done to control prosecutors in New York who brought the charges in the first place, suggesting they were going rogue.

I saw that last night. Haven't heard any pounding on the chests or other drama from the Repubs like they did after the tarmac meeting.

NBC News
Probe of Trump's charity could crash 'like a Mack Truck' into his real estate empire

"There seems to be entanglements in terms of people and probably in terms of money," said Mimi Rocah, a former federal prosecutor and NBC News/MSNBC legal analyst. ...

"Nothing but overlap here. It all was held so tightly by he and his family members," NBC News/MSNBC legal analyst Glenn Kirschner, a former federal prosecutor, told NBC News.

"I don't think there will be any investigative daylight between what the New York state authorities and investigators are looking into with respect to the foundation vs. the organization vs. anything else involving business dealings that have the name 'Trump' attached to them," he said, predicting that the foundation investigation will "crash through (the Trump Organization) like a Mack Truck." ...

The deal won't stop the civil lawsuit that Underwood filed in June against the foundation, which was formed in 1987. The AG's office continues to seek nearly $3 million in restitution plus additional fines as part of the suit, as well as a ban on Trump's leading a New York nonprofit for the next decade and placing one-year bans on the charity's other board members, which include the president's adult children.

Daniel Goldman, a former federal prosecutor and NBC News/MSNBC legal analyst, said that because some of the same people alleged by the state attorney general of persistent illegal activity in running the charity are also involved with the president's business, there is reasonable justification in broadening the investigation.

"It is likely that the investigation into the Trump Foundation has sufficiently overlapped with the Trump Organization that (state) investigators would be justified in extending their investigation into the Trump Organization," he said.

I realize these are NYState charges, but I've been wondering for awhile about the independence of the SDNY office, how that independence came about, and why SDNY is able to maintain that distance from the DoJ. :?: Is that true for other District offices :?:

IIRC, the actual U.S. attorney for the SDNY appointed by Trump recused himself. So that adds another layer between Trump and the person actually in charge.

I remember something about that. We were all worried trump was prosecutor-shopping, and then the guy he picked recused himself. Wasn't that the guy who replaced Bharara

Good times.

The Guardian
Russian who attended Trump Tower meeting charged with obstruction of justice

Natalia Veselnitskaya, who met Trump advisers in 2016, accused of fabricating evidence in separate money-laundering case

A Russian attorney who attended a notorious meeting at Donald Trump’s campaign headquarters during the 2016 presidential election campaign has been charged by US authorities with obstruction of justice.

Natalia Veselnitskaya is accused of fabricating evidence in a US money-laundering case she was working on when she visited Trump Tower in June 2016 to meet senior Trump advisers including his son Donald Jr and son-in-law Jared Kushner.

Federal prosecutors in New York said on Tuesday that Veselnitskaya and a senior Russian official drafted a bogus investigation report that she presented in court as supposed evidence that exonerated her client, Prevezon.

The US attorney in Manhattan, Geoffrey Berman, said in a statement that acts like Veselnitskaya’s “undermines the integrity of the judicial process” and threatens the enforcement of justice.

Berman said: “We take seriously our responsibility to protect the integrity of the judicial proceedings in this district, and we will not stand idly by while outside influences seek to corrupt and pervert that process.”

More details to follow …

The Veselnitskaya Obstruction Indictment: A Collusion Tale ...

Nawaday, a partner at Kelley Drye in New York, had previously worked as an assistant U.S. attorney in the Southern District of New York, where she had helped run a curious civil forfeiture case in which a Russian-owned real estate firm, Prevezon Holdings, allegedly used laundered money to acquire New York real estate. The money was believed to be the product of sham lawsuits in Russia and elsewhere; the scheme was discovered and reported by investor Bill Browder and Russian lawyer Sergei Magnitsky. ...

As Nawaday recounted, U.S. prosecutors had submitted a request to the Russian government for records pertinent to their money laundering case against Prevezon. The Russian government responded, refusing to provide documents, asserting that there was no connection between the tax fraud scheme and the allegedly fraudulent New York real estate purchases, and suggesting that Browder should be investigated instead. What Nawaday didn’t know during her time at SDNY was that her opposing counsel in the case, a woman named Natalia Veselnitskaya, had an extensive role in preparing Russia’s response to the SDNY’s document request, and that her role was memorialized in a series of emails between Veselnitskaya and Russian officials.

If the name Natalia Veselnitskaya sounds familiar, that’s because she’s the same Russian lawyer who showed up at the infamous Trump Tower meeting, at which she discussed “adoptions” with senior Trump campaign officials, having gotten the meeting by promising dirt on Hillary Clinton as part of the Russian government’s support for Trump. Whether Robert Mueller will show any kind of collusion between the Trump campaign and Russia in its 2016 election interference remains to be seen. What this indictment clearly shows, assuming the government can prove its case, is that Velnitskaya was definitely colluding with Russian government actors in the Prevezon case.

Nawaday said she was first shown the aforementioned emails as part of MSNBC’s reporting for a story in April 2018 by Richard Engel about Velsnitskaya’s connection to the Kremlin. Nawaday told MSNBC she was shocked by the emails, calling them “profoundly troubling and inappropriate.” She noted that the content, if confirmed, raised “serious questions about obstruction of justice.”

Serious indeed.

Today, the federal district court in New York unsealed an obstruction of justice indictment of Veselnitskaya for the precise conduct Nawaday described. The importance to the larger unfolding of L’Affaire Russe of the indictment, remains, at this stage, altogether unclear. The subject of the indictment is not the Trump Tower meeting, after all. The case against Veselnitskaya was also not brought by Mueller, but by prosecutors in Nawaday’s old office—suggesting that the matter may simply involve misconduct unrelated to L’Affaire Russe. Nawaday says she doesn’t know of any connection.

Email Purge Alleged in Money-Laundering Suit Tied to Trump Soho

The son of a former Kazakh politician accused of embezzling state assets used hundreds of accounts for encrypted emails to hide business activities while facing a U.S. money-laundering lawsuit that involved purchases of condos developed by Donald Trump, according to a bank seeking to recover billions of dollars it claims were stolen.

Ilyas Khrapunov also ignored court rules requiring the preservation of evidence by purging accounts and failing to produce documents related to hundreds of millions of dollars in real-estate deals, Kazakhstan’s BTA Bank JSC said in a filing Tuesday in Manhattan federal court. The bank also claims he hid the location of a key witness in the case, who was eventually located in California and deposed.

It’s the latest twist in a years long dispute rooted in claims that Khrapunov’s father, Viktor, stole $300 million from the City of Almaty while he was mayor and that a close associate, former BTA Bank Chairman Mukhtar Ablyazov, embezzled $4 billion from the company. The bank accuses the trio of using real-estate projects in Europe and the U.S., including three units at the Trump Soho, to launder $440 million as authorities were probing the alleged thefts.

“Ilyas was living under a constant threat of litigation, on many fronts, from at least 2010 into 2014,” BTA Bank said in the filing. “Nevertheless, even when faced with actual litigation by the Kazakh entities, he ignored his preservation obligations and instead destroyed the many records” controlled by him and by the investment company he founded for the real-estate investments, Triadou SPV SA, the bank said.

New York Times
At Trump’s Inauguration, $10,000 for Makeup and Lots of Room Service

WASHINGTON — Private donors put up $107 million to usher Donald J. Trump into office in style two years ago, and it is now clear just how enthusiastically his inaugural committee went to town with it. ...

Inaugural committees are required to document every donation with the Federal Election Commission, and the Trump team’s reports are now under investigation by federal prosecutors in Manhattan and Brooklyn. Investigators are also looking into whether any foreign donations, which are illegal in the United States, were passed through Americans, and whether any donations went unrecorded, people familiar with the investigations said.

People involved with the committee have said they vetted all donors, but that they could only do so much to prove someone’s money was their own. False statements to the Federal Election Commission can be a crime.

The investigation by federal prosecutors in Manhattan was prompted at least partly by a recording that Mr. Trump’s former lawyer and fixer, Michael D. Cohen, made of a conversation he had with a central figure in the inaugural planning, Stephanie Winston Wolkoff, shortly after Mrs. Trump ended Ms. Winston Wolkoff’s role as an unpaid adviser to the first lady. Ms. Winston Wolkoff was dismissed after initial reports about the amount of money taken in by the entity she formed to help produce the inaugural. ...

Overall, the Trump team’s spending appears “astronomical,” said Emmett S. Beliveau, who was chief executive officer of Mr. Obama’s first inaugural committee.

Mr. Jenkins, who handled the Bush inaugural, said the scale of the Trump team’s spending “blows me away.”

Trump Corporation broke the law by doing legal work for President Trump's 2020 campaign, complaint charges

One of President Trump’s namesake companies has repeatedly broken New York state law over the past two years by serving as a de facto law firm for the President’s reelection campaign, according to a new complaint filed with the state attorney general’s office.

The complaint, which was submitted Thursday by watchdog attorney Whitfield Larrabee and obtained by the Daily News, calls on AG Letitia James to open an investigation into legal bills paid by the President’s campaign.

Federal Election Commission filings show the Trump 2020 campaign paid the Trump Corporation $178,300 for “legal consulting” between June 2017 and August 2018.

In June 2017 alone, the campaign dished out $89,651 on such consulting services, according to the filings.

Similar payments were issued to the corporation every other month going forward, according to the records.

Tom Barrack, Inauguration Committee chairperson, was interviewed by Mueller pretty early on. He's a long-time friend and sometimes business partner of trump. Iirc, Barrack lent Jared 70+million bucks for the infamous 666 building, and when Jared was facing bankruptcy because of The Number of the Beast Building, Barrack, at the behest of trump, refinanced to keep Jared afloat. Barrack is scum, just like everybody who associates with trump. Tom Barrack is 71 years old, so a prison sentence, however short, might not look too good to him. Thots and prayers.

New York Times
Trump Inaugural Committee Ordered to Hand Over Documents to Federal Investigators

President Trump’s inaugural committee was ordered on Monday to turn over documents about its donors, finances and activities to federal prosecutors in Manhattan, according to two people familiar with their investigation into the committee’s activities.

A lawyer working with the inaugural committee received a subpoena on Monday evening seeking documents related to all of the committee’s donors and event attendees; any benefits handed out, including tickets and photo opportunities with the president; federal disclosure filings; vendors; contracts; and more, one of the people said.

Prosecutors also showed interest in whether any foreigners illegally donated to the committee, as well as whether committee staff knew that such donations were illegal, asking for documents laying out legal requirements for donations. Federal law prohibits foreign contributions to federal campaigns, political action committees and inaugural funds.

A spokesman for the inaugural committee said it was still reviewing the subpoena and intended to cooperate with the investigation. A spokesman for the United States attorney’s office in Manhattan declined to comment. ABC first reported that a subpoena was in the works.

The subpoena marked an escalation of the investigation, which the prosecutors opened late last year amid a flurry of scrutiny of the inaugural committee. The United States attorney’s office in Brooklyn is separately investigating whether foreigners illegally funneled donations to Mr. Trump’s inaugural committee using so-called straw donors to disguise their donations. Federal law prohibits foreign contributions to inaugural committees.
