AP: Supreme Court: Trump can use Pentagon funds for border wall:
The Supreme Court cleared the way Friday for the Trump administration to tap billions of dollars in Pentagon funds to build sections of a border wall with Mexico.

The court’s five conservative justices gave the administration the greenlight to begin work on four contracts it has awarded using Defense Department money. Funding for the projects had been frozen by lower courts while a lawsuit over the money proceeded. The court’s four liberal justices wouldn’t have allowed construction to start.
So, this just lifts the stay, it doesn't end the suit, right?

That's a funny way of saying Mexico is paying for it.

"We are pleased that the Supreme Court recognised that the lower courts should not have halted construction of walls on the southern border," Alexei Woltornist, a spokesman for the Justice Department, said in a statement.

Correct, but I think the suit is effectively over. The government had to spend the money by the end of the fiscal year; lifting the stay allows that to happen.

By the time the suit is complete, the money will have been spent; construction may have been completed.

With money likely withheld from the troops that are deployed to that border ?

Are you sure about having to spend it this fiscal year?

If that's correct, how much are they really going to be able to spend on actual wall building by the end of September? Probably not that much.

"Spent" means enter into contracts. The government could spend the money now for goods and services to be delivered later.

See-saws built on border fence between US and Mexico

By CNN
4:53pm Jul 31, 2019

It may seem like an ordinary scene: Children and adults playing on pink seesaws, carelessly laughing and chatting with each other
But this is a playground unlike any other. These custom-built seesaws have been placed on both sides of a slatted steel border fence that separates the United States and Mexico.

The idea for a "Teeter-Totter Wall" came from Ronald Rael, an architecture professor at the University of California, Berkeley, and Virginia San Fratello, an associate professor of design at San Jose State University -- and it was a long time coming.

In 2009, the two designed a concept for a binational seesaw at the border for a book, "Borderwall as Architecture," which uses "humour and inventiveness to address the futility of building barriers," UC-Berkeley said.

Ten years later, their conceptual drawings became reality. Rael and his crew transported the seesaws to Sunland Park, New Mexico, separated by a steel fence from Ciudad Juárez, Mexico.

The New Mexico town is also where a militia detained migrants this year and where a private group built its own border wall using millions of dollars raised in a GoFundMe campaign.

But along another stretch of the border in Sunland Park on Monday, the scene was dramatically different.

People from both sides came together to play in a "unifying act," the University of California said in a statement. Participants on the Mexico side had no planning, it said.

In an Instagram post, Rael said the event was "filled with joy, excitement, and togetherness at the borderwall."

Exclusive: Private GoFundMe border wall effort now under criminal investigation

Published 2 days ago on August 5, 2019
By Grant Stern, DCReport @ RawStory

Florida officials are conducting a criminal investigation of WeBuildTheWall Inc., a group which says it will build privately the wall on the Mexican border touted by Donald Trump. The organization has raised more than $20 million through a GoFundMe campaign amid questions about how $1.7 million was spent.

We reported in June that WeBuildTheWall Inc. was under civil investigation by Florida regulators concerning possible misuse of donations.

Brian Kolfage Jr., the wall organization’s president, asserted in an email “there’s no criminal investigation.” Kolfage had no further comment after being advised that Florida officials had put in writing that a criminal investigation is underway and confirmed it in an interview.

The wall group has erected a half-mile segment of fencing, but work stopped temporarily when local officials said the project violated local zoning laws.

Last month, this reporter sent Florida’s Department of Agriculture and Consumer Affairs a public-records request for “copies of any notices, subpoenas, or any other records pertinent to the investigation of WeBuildTheWall Inc.” The agency oversees Florida charities.

“Your public records request was forwarded to the Office of General Counsel for handling,” the department’s senior attorney Rob F. Summers wrote late last week. “The records you requested are exempt from disclosure pursuant to s. 119.071(2)(c)1., F.S. (Active Criminal Investigation).”

When asked for details, a department spokesman tersely wrote, “We cannot comment on ongoing investigations.” The spokesperson cited the same statute in declining to expand on the letter revealing the criminal probe.

That means that the criminal investigation into the wall effort is now in the hands of the Florida Office of Agricultural Law Enforcement.

They can build a wall faster than anyone but they can't get someone to proofread their plea for cash?

I'm not encouraged.

President Trump is so eager to complete hundreds of miles of border fence ahead of the 2020 presidential election that he has directed aides to fast-track billions of dollars’ worth of construction contracts, aggressively seize private land and disregard environmental rules, according to current and former officials involved with the project.

He also has told worried subordinates that he will pardon them of any potential wrongdoing should they have to break laws to get the barriers built quickly, those officials said.

Trump has repeatedly promised to complete 500 miles of fencing by the time voters go to the polls in November 2020, stirring chants of “Finish the Wall!” at his political rallies as he pushes for tighter border controls. But the U.S. Army Corps of Engineers has completed just about 60 miles of “replacement” barrier during the first 2½ years of Trump’s presidency, all of it in areas that previously had border infrastructure.

Now that gives me a great smile of Schadenfreude :-D

Teh Donald in panic, but I wonder why when he always claims all polls are top in his favour?

Apart while he may be able to shanghai some budget positions and attempt to spend them on the border wall, DHS can't cut short on the red tape. They will only get caught up incourt for prolonged time. While $$$ may not be a significant problem, DHS and the Army Corps of Engineers cannot just order construction companies to work for them. They are in competition with the public sector. Resources are limited, especially man power will be a problem. Hey, cutting corners may include ignoring illegal immigrants working on The Great Wall :lol:

a late addition to my prior post:

In effect Teh Donald gets only gets to grant the WH staffers and political appointees.

It's tricky for the political staffers, who guarantees that any wrongdoing will be investigated while this dotus is still in office, the chances are great that this dotus will not be in the Oval Office anymore to speak a pardon. Also too - no compensation for legal aid was mentioned.

Career workers in the Deep State will stick to the red tape of regulations. Nobody would be paying their attorneys when they are handed over to prosecutio for taking shortcuts. Nobody will be compensating them the loss of their retirement funds. Nor will anyone ever be thinking of offering them a job on the re-election campaign, a campaign that will be dead by the time courts speak and the job loss is confirmed. And having a criminal offense on the CVS will not make future job searches any easier.

As for resources, the adminstraton itself has limited resources. The current manpower is designed to handle the workload of the current wall building. From gplanning and getting quotes to placing orders and supervising the fullfillment.Getting more wall built would need a spike in personnel (think also office space). Personnel that first needs to be found, interviewed and signed up for, then trained on the specifics of federal procurement.

</brainstorm>

Reuters: Pentagon pulls funds for military schools, daycare to pay for Trump's border wall:
The Pentagon said on Wednesday it would pull funding from 127 Defense Department projects, including schools and daycare centers for military families, as it diverts $3.6 billion to fund President Donald Trump’s wall along the U.S. border with Mexico.

Schools for the children of U.S. military members from Kentucky to Germany to Japan will be affected. A daycare center at Joint Base Andrews in Maryland - the home of Air Force One - will also have its funds diverted, the Pentagon said.

* * *

On Tuesday, the Pentagon said the first $1.8 billion would come from projects outside the United States, followed by projects inside the country.

* * *

The list of affected projects also includes roads, maintenance shops, equipment storage buildings and hazardous material warehouses.

* * *

Some $30 million in funds for an equipment building at Fort Huachuca in southern Arizona will be diverted to pay for the wall.

Trump Administration Scraps 20 Miles of Wall After Savings Fade
Friday, 13 September 2019 10:09 PM

The Trump administration scrapped three border wall projects that it said it intended to build using money found from cost savings in constructing other portions of the barrier along the southern border.

In a court filing Friday, the administration said it had determined the savings weren’t sufficient to pay for the additional 20 miles of wall in Arizona and California.

A divided U.S. Supreme Court in July allowed the administration to start using disputed Pentagon funds to construct more than 100 miles of fencing along the border, letting the president take his biggest step yet toward erecting his long-promised wall.

The case is Center for Biological Diversity v. Trump, 19-cv-408, U.S. District Court, District of Columbia (Washington).
