I don't know if my question/issue is similar to Sugar Magnolia's, but the problem I'm having with "fair usage" related to political speech is the notion that it is okay to use copyrighted "things" completely unrelated to the political speech for no other purpose than embellishment. In other words, why do I get to mate a catchy copyrighted tune with my political speech? It seems that as long as I can claim the music is meant to get people to pay attention to my political drivel I'm free to use it under the fair usage doctrine.

Thanks for your previous response. I'm trying to understand. :)

I have exactly the same problem as Mr. Gneiss. The work being used has no political message in itself and is unrelated to the political message of the appropriator.

So if I claim to have a political message, can I use any copyrighted work? Is there a test for real political speech?

Is it really right to use an artists music not just for political speech, but political speech they oppose? Imagine if Alexandra Ocasio-Cortez started running commercials with Ted Nugent music. Is it fair use to make Ted Nugent "Cat Scratch Fever" into the AOC Democratic Socialist Utopia theme song?

It wasn't just a graphic on a misleading tweet from Trump. It was a screen shot of a FOX graphic, and ,Lou Dobbs talked about it, digressed for a minute, then went back to it, with a guest talking about how "correct" that was...
And that was a perfect screen grab.
So, a fake graphic
Lou Dobbs endorsing it.
A guest reinforcing it.
A perfect screen grab, then passed to whoever does the tweets.
Then the tweet.

This was by no means an accident (in my humble tin foil hat opinion) but rather a perfect use of 1984 "Doublethink".
This is radically different than what happened before. And, we are just so conditioned now that it doesn't ring the alarm bells.

That's a moral rights argument, but we're not (our accession to the Berne Convention notwithstanding) really a moral rights jurisdiction. Copyright in the US tradition is supposed to be a purely economic right - a government-granted monopoly that's intended to allow a limited set of protections for a limited time. We keep expanding the extent and time of the protections (which makes things like fair use more important in my view, not less), but the incentives-based core is supposed to remain intact.

I get the "fair use," etc., since the video was made by a common man so to speak. IF the video had been made by the Trump campaign, does that mean something different?

I wish the media would start educating people about the concept of sanctuary cities, particularly the fact that the idea was pushed very hard by conservative law enforcement. And, for a very good reason. People who are in the country illegally were often afraid to report crimes and would not be willing to testify about crimes because of the fear of deportation. Sanctuary was intended to protect people from being automatically deported IF the fact of their being in the country illegally would ONLY have been found out because of their willingness to cooperate with law enforcement and prosecutors.

The Democrats in New York were right to table that bill for a later legislative session.

It would have granted free tuition to anyone who is a spouse or child of anyone who died in service, in combat (gold star) or not.

The problem is, they have no idea just how many people that would be.

And besides, gold star families in New York already get tuition breaks.

By default, I am suspect of any legislation that is designed to invoke sympathies to garner support. They are rarely given a detailed analysis prior to being voted for from an emotional place.
