There are 2 overflow courtrooms. And in some courts there are Wi-Fi connections in the courtroom itself.

If that is true why did Cohen's lawyers identify Hannity as a client? :think:
Apparently because some of the seized materials were either communications between Hannity and Cohen or documents or recordings involving Hannity? But are they privileged if Hannity never intended to hire Cohen? (There is some reason to believe that communications with or documents created for a potential client are covered by privilege, at least until you decline representation. But that does not seem to cover the scenario Hannity describes.)

Adam Klasfeld

Hendon says that the government may fail at even good-faith efforts to identify privileged material since "A taint team is even further removed."

"Privileged material may not be recognized as such," she adds later.

Judge Wood calls her premise wrong, as gov't will talk w/ her.
Adam Klasfeld

Wood: "You're getting into areas that we don't need to deal with now."

She wants to know how to get the matter to the "next step" and "get it underway."

McKay back up to comment on that
.

@KlasfeldReports

McKay argues that Cohen's awareness of his own files undercuts the argument from Team Trump.

"Cohen is sitting at the table and is zealously asserting his client's interest."

And...

"The premise that Mr. Cohen can't successfully navigate his client's files rings hollow."

Bear in mind that Cohen has every incentive to exaggerate his client communciations to try to derail the doc review, so he may be spinning Hannity into a client when he really isn't, or is only minimally for a few communications.

So Hannity just asked Cohen a few questions about various aspects of the law, never paid a nickel, just doing his job as a reporter of the news, never became a client ...

... AND THEN TOLD COHEN, WHATEVER YOU DO, DON'T TELL THE JUDGE I WAS YOUR CLIENT, but Cohen says he was a client anyway, when the judge orders him to disclose his clients' names.

Sniff, sniff, something smells funny. Can y'all smell that? :-

McKay counters that the American citizen whose stuff was taken was someone whom a magistrate judge found evidence of crimes.

Judge Wood: "I have faith in the Southern District U.S. Attorney's Office."

But in terms of "perception of fairness," a special master "might have a role here," if a more limited one.

We're getting into a He Said-He Said situation because Hannity's and Cohen's stories aren't quite fitting.

But once everyone huddles, I would not be surprised if the agreed-upon story is that Hannity sought Cohen's advice concerning possible areas of representation, Cohen drafted some notes, etc., but they eventually decided not to pursue the matter.

Ive hated Hannity ever since I heard outtakes of him during the Terri Shiavo circus. He was standing around getting man-on-the-street interviews and also hitting up pretty ladies, which is just so ghoulish to be doing at the same time.
I've always imagined that's why he created "Hannidate."

She solicited proposals on how to move fast.

If Hannity told cohen that he was being blackmailed/extorted in the context of seeking legal representation and cohen declined to represent hannity, that conversation would be privileged, even if no representation resulted or retainer paid. IMHO. It is a communication made for the purpose of seeking/giving legal advice. Having said that, I think Hannity is lying anyhow.

I take it mean that the defendants/intervenors may still request injunctive relief. But they have to do so in due course, i.e., noticed motion, evidence, etc. (None of this showboat-y emergency TRO stuff.)

So far Hannity and Trump's lawyer have thrown Cohen and his attorneys under the bus.

Only Elliot Broidy, who was outed in all of this, hasn't, and he's a victim of Cohen's conduct.

Eric Garland suggests someone else could have paid the bills and received the invoices for Cohen's services for Hannity because of the way Hannity 's disclaimer is written.

Sean Hannity

@seanhannity
Michael Cohen has never represented me in any matter. I never retained him, received an invoice, or paid legal fees. I have occasionally had brief discussions with him about legal questions about which I wanted his input and perspective.

The parties are supposed to propose names for a special master. That won't happen today.

Judge Wood says she hasn't decided whether to appoint a special master.
