Is it at all likely the Ninth will consolidate Liberi v Taitz and Liberi v DOFF appeals?More than likely. (So the threads should eventually be merged.)

Apparently there was a misunderstanding in regards to the Appeal in questionThe appeal involves 2 entities "Defend Our Freedoms Foundation" where Orly Taitz is the president and Orly Taitz as an individual. Both entities were supposed to be part of one appeal, however 2 separate appeal numbers were assigned and separate schedules were assigned. I am asking to join both appeals 11-56079 and 11-56164 and issue one schedule. [highlight]I am also asking for one appeal fee[/highlight].Consolidating the appeals is not a problem. But there was no "misunderstanding": You, Taitz, filed a NOA without first consulting counsel for the other defendants, forcing them to file another one.Teamwork! :-bd Sekrit Stuffs!
And the letter asking for consolidation doesn't go to the mediation unit!

Defendant, Defend OurFreedoms Foundations, allegedly maintains a website that has publicized public information regarding Plaintiffs, including information pertaining to Lisa Liberi's criminal convictions, and a dispute between Lisa Ostella and Defend Our FreedomsFoundation. Plaintiffs have accused Defendant of violating their rights to privacy and defamation.1. Taitz's site is registered to Taitz; DOFF is not the registrant.


2. "Allegedly maintains"? You, DOFF's "president," doesn't know if it maintains a website?


3. "rights to privacy and defamation"??!? (There is a right to defamation?)

I can't wait to see Orly Taitz's exposition on C.C.P. sec. 425.16 (the anti-SLAPP statute). It's an area I have litigated quite a bit in the trial courts and on appeal. I can hardly wait to get the new insights that Taitz will provide, and the clear explanation of why the trial judge was wrong.(Quite frankly, she should have won her motion on a couple of the claims. But Taitz completely screwed up the motion, so it's probably 80-20 against her getting a reversal.)
