I can't find it now, I think it was twitter, something to the effect that the report coming out is prelimin because they can't do a final report without routers and all that other nonsense. so I expect this report to mostly whine about that.

As I recall, the Election Board has told CN to be prepared to defend their report in court. Can they do that with the prelim or does it have to be the final?

The report itself (preliminary or otherwise) has no intrinsic forensic value; decision-makers will cite it as justification regardless of its contents or accuracy. It is just a prop.

As an addendum, there are 28 points you have put in pen. Each of these are unedited as much as possible, copies of your email response to me,

Rebuttal to item 1: Karen Fann the Arizona Senate President has issued supenas listing material and data not turned over to the audit. MBOS does not control a legislative audit. If the MBOS had conducted a competent audit, an additional audit wouldn’t be called for. “We the People” are not happy and don’t believe the MBOS. We want to see the MBOS audit as do the constituents of AZ. Providing a manual of what is supposed to be done, item 27 in your response, “2019_ELECTIONS_PROCEDURES_MANUAL_APPROVED.pdf” is not an audit it’s a procedure. Show me what was audited, I know ballots were counted, multiple times. Decks of cards have 52 cards, but 52 different cards, I want to see how you counted each ballot, where you counted the ballot, and how each ballot was verified to be a legal ballot. Chapter 12, section II says a post-election logic and accuracy test is to be performed. I want to see it / them. Logic and accuracy tests are not audits. Partial precinct, hand counts of 2% and 5% recounts of votes are not audits. In the 274+ pages there are so many places to commit mistakes or outright fraud it’s not worthy of discussing now. I will read it and become aware, I am now awake!

Rebuttal to item 2: Recounting ballots as was done in the election process is not an audit, it’s a recount. Like I said decks of cards have 52 cards, but there are never duplicates, or missing cards. Voter registration is similar to the 52 card limit. Only an audit can catch errors be they duplicate, missing, or overcounts. Just having 52 cards doesn’t make the deck complete or audited. In the 2019_ELECTIONS_PROCEDURES_MANUAL_APPROVED.pdf procedures, how are missing or duplicate ballots discovered. For that matter, how are legal and illegal ballots discerned. Only a forensic audit can discover these errors.

Rebuttal to item 3: The Audit contract is between the Arizona Legislators, and Cyber Ninjas. The Lead contractor. Every Contractor in existence has some bias, much like yours bias. It is your, “our unbiased” Legislator that is responsible to expose that bias if any is apparent in their deliverable. Until a delivery is made your words are simply conjecture and possibly false narrative which you may have to take responsibility for. Be careful!

Rebuttal to item 4: Any monies expended beyond the legislative funded contract is not your concern. Much like Vendors spending money to win a contract, it’s not part of the contract. How many contracts have you been involved in, you should know this.

Rebuttal to item 6: I don’t know of any public claims made by the forensic team by the name of Cyber Ninjas. Others like Fake news CNN, ABC, NPR, MSNBC, and others have referenced several false narritives concerning the audit, However, 24 hr surveillance with cameras, security, and restricted access to materials unless chain of custody of documents are signed by two parties, 1 republican, 1 democrat. So I’ll ask what specific breeches of provable irregularities are you making.

Rebuttal to item 13: Audits take time. Be patient, Legislators gave them limited funds which I’m sure they have used up. And are working on their own dime or those of anonymous donors, like myself who think the audit is worth doing.

Rebuttal to item 14: Could you be more specific in you conclusion as to what specific damage done to what equipment. As an IT professional, I know copying a disk does not damage the original disk. Reading bios settings do not damage the Bios. Reading nonvolatile memory does not change or damage memory. So I must assume you are speaking of physical damage. Please illuminate on the specific damage. If the machines were certified prior to the election, they should be able to be recertified after an audit unless, can’t think of any unless case. Please advise me on what damage.

Rebuttal to item 17: Audits in general have specific goals in mind. When over 2 million votes are being forensically audited which has never been done before. Procedures need to be modified to fit the scope of the work. Surely you know this to be an appropriate measure. Please review your own cited 2019_ELECTIONS_PROCEDURES_MANUAL_APPROVED.pdf. See how many times it has been changed. The last time was obviously in 2019 just in time for our 2020 election. It surely wasn’t written to forensically audit over 2 million ballots. Please fee to begin revising it again to reflect forensic audits for all coming elections from this day forward.

Rebuttal to item 18: Please refer me to as many certified, “actual election auditors” that you know of. Leave Dominion and associated companies out of the list, I’m sure they’d be biased. Also, who is certifying these companies. Who gave them the power to certify or decertify an audit company.

Rebuttal to item 19: I believe you have opened yourself up to a lawsuit, I’m no lawyer but, you better check with your attorney to see if your safe with these comments.

Rebuttal to item 20: I do believe your calling Concern and Responsibility to find out what was happening during the election anything other than accountable is outrageous. You should not be in office if that’s what you truly believe

Rebuttal to item 21: Again as an IT professional, router do not store packets. The do store routes and packet counts. Since most audit opposition persona have cited time and time again that voting machines are not connected to routers, just why are you officials afraid to give up voting machines and routers. If they were never connected, the routers won’t have any of their IP addresses in them would they. Are you afraid the routers will connect the dots between the voting machines and nefarious sites around the world that change vote tallies?

Rebuttal item 22: If there is a bad precedent, it’s by the AZ MBOS for connecting the voting machines onto the internet. Also even worse, if they are using the same interned connection as the sheriffs’ network they should be removed from office for incompetence.

Rebuttal item 23 Adjourning for the year is a cheap legislative ploy that “We the People” see through. It will be remembered in 2022. Further, The Legislative body can and will be recalled to continue the audit. Gov Duecy can convene a legislative meeting any time.

Rebuttal item 24: Don’t tell me your no vote didn’t count. Remember, “We the People” are watching and we will remember your actions.

Judge gives Arizona Senate 2 weeks to turn over thousands of audit records

A judge on Wednesday ordered the Arizona Senate to turn over thousands of outstanding documents related to the Maricopa County election review by Aug. 31, even as the legal battle over some records held by the private contractor running the effort lingers.

The Senate's attorney, Kory Langhofer, said the Senate is preparing about 10,000 documents, including emails about the audit, to release in an online reading room where records from the audit are posted.

Maricopa County Superior Court Judge Michael Kemp ordered their release in two weeks.
