Oh, yes. I mean, it is legally permissible, but they might receive public criticism for it.
If anything, the noisy referral by, for example, the Michigan AG, might result in words to the effect of, "What I did was legal, but the AG is on a witch hunt. So, for the sake of my family and on the advice of counsel, I assert the Fifth Amendment."
More fundamentally, innocent people sometimes assert the privilege against self-incrimination because they realize their perfectly legal actions might nonetheless incriminate them,* and draw them into the criminal-justice apparatus. Especially when heightened visibility might cause law enforcement to snoop around and discover otherwise hidden illegal activities. To say nothing about perjury traps.
* E.g., "I was driving my red car around the docks on Tuesday night" might be both true and innocent, yet also incriminating if a red car was seen driving away from a crime scene at the docks on Tuesday night.

The committee subpoenaed the following chairperson and secretary of each group of so-called alternate electors. Each state pair is listed as chairperson and secretary respectively:
* Nancy Cottle and Loraine Pellegrino from Arizona. Cottle is listed on the Arizona Federation of Republican Women's website as being the group's vice president.
* David Shafer and Shawn Still from Georgia. Shafer is the chair of the Georgia GOP and was a plaintiff in some of Trump's longshot lawsuits to overturn the election in Georgia. Still was the Georgia GOP's finance chair and is now running for a Georgia Senate seat.
* Kathy Berden and Mayra Rodriguez from Michigan. Berden was a national committeewoman at the Republican National Committee and served as a Trump delegate at the 2016 GOP convention. Rodriguez unsuccessfully ran for a Michigan House seat in 2020.
* Jewll Powdrell and Deborah Maestas from New Mexico. Powdrell recently told the Albuquerque Journal that he signed the fake certificate at the behest of former Rep. Steve Pearce, the head of the New Mexico GOP. Maestas previously served in that role, leading the state GOP.
* Michael McDonald and James DeGraffenreid from Nevada. McDonald is the Nevada GOP chairman and reportedly promoted false voter fraud claims in 2020. DeGraffenreid's Facebook page says he is a national committeeman from Nevada for the RNC.
* The committee subpoenaed Bill Bachenberg and Lisa Patton from Pennsylvania. Bachenberg is a board member of the National Rifle Association and spoke at a pro-Trump fundraiser in 2020.
* Andrew Hitt and Kelly Ruh from Wisconsin. Hitt is the former chairman of the Wisconsin GOP and a staffer for former Gov. Scott Walker. Ruh is currently an alderperson from the city of De Pere.
The subpoena letters call on all individuals to provide documents on February 11, and appear for depositions throughout the month of February.

The House Select Committee investigating January 6 has issued a subpoena Friday for a former White House spokesman with firsthand knowledge of Donald Trump's behavior before and during the January 6 attack on the Capitol, according to a copy of a letter accompanying the subpoena obtained by CNN.
The committee is seeking both documents and a deposition next month from former deputy White House press secretary Judd Deere, who helped with "formulating White House's response to the January 6 attack as it occurred," according to the panel's letter.
In its letter to Deere, the committee specifically said it wanted to speak with him about the January 5 staff meeting in the Oval Office with the President.
The committee said it had obtained information that Trump repeatedly asked in the meeting: "What are your ideas for getting the RINOs to do the right thing tomorrow? How do we convince Congress?"

U.S. District Judge David O. Carter has been presiding patiently over Mission Viejo lawyer Orly Taitz‘s effort to oust Barack Obama from the presidency on the allegation that he was born in Kenya. Carter’s kept his cool while Taitz failed to serve Obama’s lawyer with her complaint, attempted (and failed) to dismiss two of her clients, attempted (and failed) to have a magistrate judge removed, and attempted (and failed) to have a witness testify during an administrative hearing. She also had 40 to 100 of her supporters call Carter’s Santa Ana office daily to encourage him to rule in their favor. Carter responded by simply telling Taitz to knock it off.
But even judges can run out of patience, as U.S. District Judge Clay D. Land demonstrated with Tuesday’s $20,000 fine of Taitz for misconduct, issued along with a scathing, 43-page sanction. In his order, Land detailed the limits to which his patience had been stretched in a similar Obama-birthplace suit filed by Taitz in Georgia. Land noted that Taitz failed to follow basic court procedure, and that he’d overhauled his court’s schedule to accommodate Taitz. In return, Land wrote, Taitz used the courtroom to grandstand for the press, and repeatedly filed frivolous motions. “Rather than assert legitimate legal arguments, counsel chose to accuse the Court of treason and of being controlled by the ‘Obama machine.’ She had no facts to support her claims – but her diatribe would play well to her choir,” Land wrote. In a footnote, Land explained that he’d been contacted by one of Taitz’s supporters, who “challenged the undersigned (Land) to a ’round of fisticuffs on the Courthouse Square,’ (and) asserted that the President is not human.”
The fine got Taitz even more steamed, and she’s vowed to appeal it. Land, she said, was in the pocket of the “oppressive” Obama Administration. “He’s scared to go against the regime,” she said. “He’s trying to intimidate me and other lawyers to stay away from this issue.” Among other things, Land said he threw out Taitz’s case because the constitution dictates that it’s Congress’ job to determine whether the president meets the qualifications to hold office. Land goes on to cite several circumstances to support the idea that the issue should not be decided by the courts. “Perhaps an eccentric citizen has become convinced that the President is an alien from Mars, and the courts should order DNA testing to enforce the constitution,” Land wrote sarcastically, then added the footnote quoted above.
Santa Ana’s Judge Carter is considering the same constitutional issue in a motion to dismiss, which he heard arguments for on Oct. 5. Among those predicting dismissal is the conservative dean of the Chapman School of Law, John Eastman, who remains unconvinced that Obama’s birth documents are valid but believes it’s a matter for Congress, not the courts. The basic idea is that interpretation of the qualifications for the presidency is a political – rather than legal – issue. “It’s called the political-question doctrine,” said Eastman, who specializes in constitutional law. “The regulation of qualifications are assigned to Congress.”

Former White House Press Secretary Kayleigh McEnany turned over text messages to the House select committee investigating the Jan. 6 attack on the U.S. Capitol, according to a source familiar with the investigation -- the latest indication of the extensive level of cooperation the committee has received from many witnesses.
McEnany, who was at work in the White House and around then-President Donald Trump before and during the Capitol attack, was subpoenaed by the panel for records and testimony in November, and turned over text messages to committee investigators.
A source familiar with her interactions with the committee has told ABC News that text messages from McEnany's phone were quoted in a recent letter the committee sent to Ivanka Trump. The texts came directly from documents turned over by McEnany, said the source.
"1 - no more stolen election talk," Fox News host Sean Hannity texted McEnany, according to the records. "2- Yes, impeachment and the 25th amendment are real and many people will quit."
"Love that. Thank you. That is the playbook. I will help reinforce....," McEnany replied, per the documents.

Jacob was a Partner at O'Melveny (BIGLAW) and returned there after January 20, 2021. There is no way his firm would tolerate a partner thumbing their nose at the Committee. King, Klobuchar and Durbin on Tuesday released a discussion draft of their proposal to update the Electoral Count Act.
According to a summary of the proposal, the measure would, among a number of provisions, "clarify" that the vice president does not have the authority to reject a state's electors. It would establish "specific and narrow grounds" for objections to electoral votes or electors.
And it would "raise the thresholds for Congress to consider objections" while also making it more difficult for objections to be sustained without widespread support by both chambers.
