Class Action Lawsuit: Brian Flores v NFL, et. al.

#1

Post by John Thomas8 »

Recently fired Miami Dolphins coach Brian Flores has filed suit against the NFL for improper hiring practices, i.e. racial discrimination in hiring for positions of authority, notably head coach and team executives like General Manager (probably not the legal terms used, but it's the jist of the complaint).

https://www.sdnyblog.com/files/2022/02/ ... plaint.pdf

Mike Florio and Cherean Williams talk about it in these two videos.

Thanks for posting the complaint JT.

The pundits seem to think this is a big deal. I agree. The allegations that the Miami owner Stephen Ross offered to pay Brian Flores $100k k bonus for every game they lost in 2019 so they could get the #1 pick in the draft and select Joe Burrow are alone a bombshell. I think as Mike Florio said this morning the evidence of discrimination is hiding in plain sight. I would add that the evidence is all white.
1. As this Class Action Complaint is filed on the first day of Black History Month, we honor the brave leaders that fought so hard to help break down racial barriers of injustice. Martin Luther King Jr., Harriet Tubman, Rosa Parks, Frederick Douglass, Jackie Robinson and Mamie Till, to name only a few.

2. Unfortunately, however, there is so much more to be done. While racial barriers have been eroded in many areas, Defendant the National Football League (“NFL” or the “League”) lives in a time of the past. As described throughout this Class Action Complaint, the NFL remains rife with racism, particularly when it comes to the hiring and retention of Black Head Coaches, Coordinators and General Managers. Over the years, the NFL and its 32-member organizations (the “Teams”) have been given every chance to do the right thing. Rules have been implemented, promises made—but nothing has changed. In fact, the racial discrimination has only been made worse by the NFL’s disingenuous commitment to social equity.
Might I suggest the thread title be changed to reflect the case name. "Class Action Lawsuit: Brian Flores v NFL, et. al." or something to that effect.

Sure, changing the title is simple.

Changing what 31 billionaires and a multi-billion dollar corporation do to minorities is going to be hard.

Thanks. Yes, the owners will only act when their billions are threatened.

The historical problem when suing the NFL is that there's so much money available that suits rarely make it to discovery. The owners get together, chip in 6 or 7 figure antes, and present a settlement that can't be turned down.

Last year the NFL dodged discovery in two suits, one brought by the City of St. Louis and the other brought by the victims against the Washington Football Teams' owner. We saw a bit of fallout from the latter when the NFL released e-mails that made one its employees look bad so they could fire him for cause.

Yeah, Roger Goodell was hired and is paid by the owners and his #1 job is to protect them at all costs. He hid the WFT report and threw John Gruden to the wolves.

Good grief. Glad I divorced myself from American "football"(it's not football) decades ago. What a silly game. One hour of game time + two hours of commercials.

Proof that you are unAmerican!

I don't watch the NFL much but their farm team games (NCAA) are a ton of fun to watch. We solve the problem you have by recording the game and fast forwarding. Simple and satisfying solution.

:nope: Fútbol is my game ('cause it's actual football, not smash-the-other-team physically-causing-inuries-and-
repetitive-brain-concusions). -- and no commercials except during half-time.

I think this is not about sportsball stuff, really. Baseball, football, fútbol, whatever. It's about systemic racism, and Mr. Flores has sacrificed his continued career for a greater goal.

The other problem the NFL has (well, one of many) is that they are actively covering up criminal behaviour by one of their owners, danny "sleezeball" snider, and even Congress can't get honesty from the league.

The NFL has demonstrated they will pay a lot of money to keep this case from advancing. They paid $1 billion to settle the concussion lawsuit. They paid St. Louis $700 million to settle a lawsuit over yanking the Rams from them. They got off with paying a paltry $10 million to make Colin Kaepernick and the others go away. If I were to wager on this getting to the deposition stage I know how I would bet.

“Brian Flores: Pittsburgh Steelers hire ex-Miami coach who is suing NFL”:
https://www.bbc.co.uk/sport/american-football/60449408

“The 40-year-old has been appointed senior defensive/assistant linebackers coach.”
If you can't lie to yourself, who can you lie to?

Look who hired him, and guess what other head coach/franchise would.
