Amazing what you can find when just piddling around a court website. ;;) A new and previously unknown (at least to me until tonight) "birther" case in HI filed in September 30, 2011.Download of documents is not available at the Hawaii Circuit Court website, so we'll have to rely on one of Soros' Hawaii Obot operatives to enlighten us, but the face page, docket sheet and court minutes list is presented below.http://i307.photobucket.com/albums/nn31 ... 0003.jpgIt is yet another suit under Hawaii UIPA.A Mr. Richard Carville King as applied to appear pro hac vice, it appears through the Declaration of a Mr. John S. Carroll.A Motion to Dismiss has been filed. A hearing has been scheduled on the MTD forDecember 8, 2011.The Plaintiff has filed a Memorandum of its Motion for Summary Judgment with a Declaration of Thomas Putnam, a Declaration of our old "expert" buddy Paul Irey, one of "expert" Mara Zebest. That is all. \ :D /

Case No. 1CC11-1-002276John Carroll (a former [/break1]tv/story/ex-hi-gop-legislator-john-carroll-to-run-for-u.s.-senate/]state legislator) is a republican running to be the U.S. Senator from Hawaii. Carroll [/break1]wikipedia.org/wiki/Hawaii_gubernatorial_election,_2010#Republican_Party]was crushed in the 2010 republican gubernatorial primary (the winner went on to lose to Abercrombie). Lingle is favorite to win the 2012 republican senate primary.Richard C. King is an attorney [/break1]courts.state.ny.us/attorney/AttorneyDetails?attorneyId=5378372]barred in New York, and presently practicing from New Jersey. (Has been counsel of record in some Court of International Trade cases; the court is in New York City.)

John Carroll is a republican running to be the U.S. Senator from Hawaii.Yes. And this filing date, 9/30, IIRC is "pretty close" to his announcement/filing. ;)

I'd be interested in whether whoever filed this nonsense at least had the sense to plead the common law right of access as an alternate to the UIPA. Does Hawaii have that?

Mikedunford said on RCRadio that Mr. Carroll might be the lawyer who Corsi hired for the Aug. 8 hearing who Orly blew off. If he is, this probably means that Corsi has chosen to hire a real lawyer to try to get access to the original BC instead of relying on Orly's incompetent malpractice of law. More drama in birferstan!

I obtained the complaint and the state's motion to dismiss today. The plaintiff's motion for summary judgement has not made it to the file yet, nor has any reply to the motion to dismiss. There is a hearing on the motion to dismiss set for Thursday afternoon which I will probably be able to attend. I'd anticipate that this case will likely be dead by Friday morning. Complaint:[/break1]scribd.com/doc/74843071/Wolf-v-Fuddy-Complaint] ... -ComplaintMotion to Dismiss:[/break1]scribd.com/doc/74843055/Wolf-v-Fuddy-MTD] Jack Ryan wants to post a copy on his site for convenience and completeness, he should of course feel free to do so.

The plaintiff, William Wolf, alleges he is from Eatontown, New Jersey. Wolf appears to be [/break1]manta.com/g/mm2by6d/bill-wolf]the president of [/break1]motionsystem.com/]Motion Systems. And hence the attempt to PHV in a lawyer who has an office in New Jersey.

From State's Motion to Dismiss, Footnote 1:

Under the United States Constitution, the power to remove a sitting president resides in Congress. Barnett v. Obama, 2009 WL3861788.

Chalk up another Obama win courtesy of Orly Taitz! =D> \ :D / :-bd

I can tell you without hesitation that Wolf does not live on Industrial Way in Eatontown. That's his business address.

Is "Area Man Goes Birther" the type of story that might make it into a New Jersey publication? :-
