There are other disqualifiers, like a domestic-violence restraining order or mental-health restrictions.

The false statement could have been an omission, e.g., "Have you ever been arrested?" Even if you have never been convicted, answering "no" to that question would still be a false statement.

The article infers he was arrested before the transaction occurred. Either he intended to buy it for someone and was caught in a sting or there was another reason. I'll go with the "have you ever been arrested" question.

So...Kessler was charged in December 2015 with 2 misdemeanors which included making terroristic threats and waving a gun.
These new charges allege that he made a false statement while trying to buy a gun on May 5, 2016. He was acquitted by a jury of the 2015 charges in August 2016.

Therefore: he was trying to buy a gun while he was facing charges of threatening someone with a gun. Something tells me he was less than forthright about that in his application.
Edit: See: question 11b on the ATF form asking about pending cases in which you might receive more than a year in jail. Terroristic threats carries up to 5 years in the pokey.

Police said he provided "inaccurate information while completing the paperwork associated with the background check." He is free on $10,000 bail, and his preliminary hearing is scheduled for Feb. 21.

Kessler stated on the form that he was not under indictment for a felony or other crime for which a judge could impose a sentence of a year or more. The Pennsylvania Instant Check System showed that he was under indictment, and Kessler was not permitted to purchase the gun.

State police say at the time he applied for the gun on May 5, charges of terroristic threats (misdemeanor one), harassment (misdemeanor three) and a disorderly conduct (summary) against Kessler were still pending in Schuylkill County court, court records state. Kessler was found innocent of these charges Aug. 22.

A first degree misdemeanor carries a maximum penalty of a year in prison

John Fegley, first assistant district attorney:
Fegley countered by saying Dunham’s has the original records of the transaction and that the store manager guaranteed Kernag would be available at a later date.

Kirwan said that without speaking to Kernag in person, the prosecution has no idea what his future plans are and where he will be months down the line if the case goes to county court.

After the ruling, Fegley said prosecutors will re-file the charges against Kessler at a later date.

The corporal said that Kessler completed the application in the presence of Tim Kernag, assistant store manager, but attorney Robert Kirwan, Reading, Kessler’s lawyer, questioned Zulick as to what proof he had at the hearing that his client actually completed the form.

Under questioning by Kirwan, Zulick said he never interviewed Kessler to get his side of the story and that Kessler also refused to speak with him unless he was in the presence of his attorney.

Zulick also said that the section pertaining to Kessler’s driver’s license identification was filled out by store personnel. He later corrected his statement, saying that by law, Kessler himself was required to complete that part of the document.

“You can’t say who filled out the form because you weren’t there,” Kirwan told Zulick.
So the prosecution was relying on the officer's speculation; the prosecution didn't have the manager testify.

It would appear Kessler's anticipated defense is to throw the manager under the bus, and claim that the manager actually completed the paperwork. (Which may in fact be true.)

Not much recent news about Mark Kessler. Gilberton moves on. Guess they need the parking fines money. ;)

Seriously, how many parking fines can a town of 700 people generate? Hard to believe that Gilberton once had 5400 residents. That was in 1910. Since then the population has been falling as the coal mines declined.

At Monday’s special meeting, the Frackville Borough Council agreed to enter into the agreement with Gilberton that would permit its police department to provide law enforcement duties to its neighboring municipality. The vote was 7-0.

The borough has been without a police force since July 31, 2013, when Kessler was suspended for allegedly using borough automatic weapons on his own time in YouTube videos without permission from borough council or Mayor Mary Lou Hannon. Kessler contested the charge and after months of negotiations, both parties reached the agreement that Kessler was “separated from his employment and voluntarily retired” and he would receive $30,000 as part of the settlement.

Looks to me as if taken over by a domain name shark. Content has nothing to do with any "chief" nor with anyone named "Kessler". Chiefkessler must have lost interest and let go of the domain name or simply had no money to renew and for hosting.

Looks to me as if his domain was taken over by a hacker who overlaid the site with articles designed to generate click revenue. I've seen such takeovers before, including a friend's personal website that was taken over and filled with Japanese clickbait.

Done at last what I ought to have done from the beginning: look up the WhoIs. The domain seems to still belong to Kessler, purchased possibly for ten years thru Februrary 2018. So yes, his website may have been hacked and taken over.
