4th Circuit Rules Against Virginia’s Ban On Same-Sex Marriage

The Fourth Circuit Court of Appeals ruled 2-1 Monday that Virginia’s ban on same-sex marriage is unconstitutional, upholding a lower-court ruling from February. The majority concluded that “Virginia’s same-sex marriage bans impermissibly infringe on its citizens’ fundamental right to marry.”

:snip: http://www.thefogbow.com/forum/viewtopi ... p630222The 4th Circuit Court panel that ruled on this case was comprised of:

Judge..........................Nominated By...............Received Commission

Judge Paul V Niemeyer.....Pres GHW Bush.....................Aug 7, 1990

Judge Roger L Gregory.....Pres GW Bush......................July 25, 2001

Judhe Henry F Floyd........Pres Obama.........................Oct 5, 2011

Affirmed by published opinion. Judge Floyd wrote the majority opinion, in which Judge Gregory joined. Judge Niemeyer wrote a separate dissenting opinion.

The cert petition (pages 20-21) states there is conflict between the US 4th (Bostic) and 10th (Kitchen) Circuit Courts' ruling with some state Supreme Courts (Washington, Kentucky, Minnesota and Arizona) and also conflict with a ruling from the US 8th Circuit.US 8th Circuit; whoda thunk it?

BREAKING: Fourth Circuit Court DENIES Stay On Virginia Same-Sex Marriages

The U.S. Court of Appeals for the Fourth Circuit today denied a request to delay implementation of its ruling striking down Virginia laws denying marriage to same-sex couples. The court’s action means that, unless the Supreme Court intervenes, couples may begin marrying and having their out-of-state marriages recognized in Virginia on August 18. :cheer:
