Trump bemoans 'very sad time for America' after citizenship question dropped from census

President Trump on Tuesday said it was "a very sad time for America" after his administration confirmed that a citizenship question would be dropped from the 2020 census.

"A very sad time for America when the Supreme Court of the United States won’t allow a question of 'Is this person a Citizen of the United States?' to be asked on the #2020 Census! Going on for a long time," Trump tweeted.

"I have asked the Department of Commerce and the Department of Justice to do whatever is necessary to bring this most vital of questions, and this very important case, to a successful conclusion. USA! USA! USA!" he continued.

UPDATE: US District Judge George Hazel is moving up deadline to Friday, July 5, at 2 p.m. ET for Trump admin to enter written agreement that confirms it’s no longer pursuing #CitizenshipQuestion on #2020Census,

SOURCE: The DOJ reversed course to Judge Hazel, told them that they've been "ordered" to try to get the citizenship question back on the census, and that no final decision has been made yet, but their "current plan" is to go directly to SCOTUS to bless whatever they decide.

Question for those who know about Supreme Court procedure (See second to last paragraph). :geezertowel:

The case has been remanded and I assume what we called a "Mandate" with instructions to the lower court has been issued.

Is there any rule or procedure that allows them to go back to the Supreme Court and get a do over without having, at the very least, another appealable order from the lower court (not to mention other steps between the District Court and getting back in front of the Supremes)?

If not, is there any chance they'll make an exception for the Trumpenfuhrer?

The legality of such an executive order would probably lead to a 9-0 SCOTUS vote striking it down.

On the other hand, Trump could ignore it. Congress doesn't seem to be interested in anything more than getting re-elected. That criticism is directed to both houses.

I'm curious as to why the president believes an executive order is a magic solution. As if executively ordering the commerce secretary is somehow different. ("I executively order you to ignore the APA.")

Hey media--Trump cannot issue an executive order to include a citizenship question in the Census. The Census requirement is found in Article I (not Article II) and thus is a right of Congress, not the President.

It's in Article 1. So is the Appropriations Clause. Which Trump has ignored with his Executive Order to spend money and bill a wall. And Congress hasn't restrained him, and the House hasn't even moved to impeach him. So why is this any different?

Intentionally violating a valid injunction would subject people (real people, not just the president and his machine) to contempt proceedings.

Civil contempt would be initiated by the Plaintiff's in the lawsuit. If the judge decides to cite for criminal contempt they can appoint special prosecutor.

Total pipedream, :daydream: , but if Trump were held in civil contempt, it would be an unthinkable confrontation and Constitutional crisis to order him jailed, but if they fined him a couple of million dollars a day and ran a garnishment on his personal bank accounts, what could he do about that other than whine?
