It’s not just the “Fake News Media” that parses President Trump’s tweets in microscopic detail and uses them against him. Federal judges do it too.
The White House yet again learned that the hard way when, on Tuesday, U.S. District Judge William Alsup in San Francisco blocked the administration’s attempt to phase out Deferred Action for Childhood Arrivals, the Obama-era program that protects young undocumented immigrants from deportation.
Alsup was tasked with, among other things, determining whether it would serve the public interest to leave DACA in place while litigation over the decision to scrap the program proceeds.
On this point, he had an easy answer: Trump himself had expressed support for DACA on Twitter in September, just days after Department of Homeland Security officials rescinded it.

This relieves pressure on the Dems in the budget negotiations. DACA was their primary goal. Am I missing something?

Dems had better not feel relieved. Dems need to get DACA resolved now. IMO they will never have more leverage than in the current negotiations to keep the government funded.

Dems need to get DACA resolved now. IMO they will never have more leverage than in the current negotiations to keep the government funded.

The judge's decision to halt the new executive order seems to rest in part on DACA being legal in the first place. That's far from 100% certain, and, in any event, DACA was never supposed to be a permanent solution. A permanent fix has always been a Congressional responsibility.

Jeff Flake announces a bipartisan solution among Senators. It's probably either a clean bill or with few impediments to its passage -- in the Senate. But Pubs in the House don't want to pass any bill, so Ryan will insist on a wall.
At some point Trump may come in and cram it down Ryan's throat. But that would require some actual deal making so no one should get his/her hopes up.

Judge: Trump racism may have been key to ending DACA
The federal judge who earlier this week ordered the reversal of President Donald Trump's decision to end the program protecting so-called Dreamers said in a new ruling Friday that it is "plausible" that Trump shut down the program for racial reasons.
"These allegations raise a plausible inference that racial animus towards Mexicans and Latinos was a motivating factor in the decision to end DACA," U.S. District Court Judge William Alsup wrote, referring to the Obama-era Deferred Action for Childhood Arrivals program bestowing quasi-legal status and work permits on undocumented immigrants who entered the U.S. as children.
Alsup noted that two of the suits filed challenging the decision the Trump administration announced in September to wind-down the program cited Trump's anti-Mexican and anti-Latino rhetoric during the 2016 campaign, including his description of Mexicans as rapists and of immigrants coming across the southern border as "animals."
"Circumstantial evidence of intent, including statements by a decisionmaker, may be considered in evaluating whether government action was motivated by a discriminatory purpose," wrote Alsup, an appointee of President Bill Clinton. "These statements were not about the rescission (which came later) but they still have relevance to show racial animus against people south of our border." ...
Alsup's analysis came Friday in connection with five lawsuits he is handling over the Trump administration's cancellation of DACA. The bulk of his latest, 14-page order was technical in nature, allowing certain claims to proceed while dismissing others.

DACA Recipients Can Apply For Renewal, Government Says
The Department of Homeland Security says it will once again accept renewal requests from recipients of the Deferred Action for Childhood Arrivals program in response to a court order.
"Until further notice, and unless otherwise provided in this guidance, the DACA policy will be operated on the terms in place before it was rescinded on Sept. 5, 2017," U.S. Citizenship and Immigration Services, a part of DHS, wrote on its website Saturday.
The Obama administration began the program in 2012, which enabled certain young immigrants brought to the U.S. illegally as children to apply for work permits and protection from deportation. As of September, about 700,000 people are currently protected under the program.
Attorney General Jeff Sessions announced in September that the Trump administration would wind down the DACA program. The administration said it was executive overreach and called on Congress to come up with a solution to the status of DACA recipients, also called DREAMers.
But a federal judge in San Francisco halted that plan late Tuesday and ordered the administration to resume processing DACA renewals while a lawsuit against the September decision moves forward.

CBS: Trump administration appeals DACA decision:
The Department of Justice has appealed a federal court's decision over the Deferred Action for Childhood Arrivals program, it announced Tuesday.
The DOJ has appealed a lower court's decision in The Regents of the University of California and Janet Napolitano v. U.S. Department of Homeland Security and Elaine Duke, to the 9th Circuit Court of Appeals and will ask the U.S. Supreme Court take up the case directly. The appeal comes after a U.S. district court temporarily blocked the Trump administration from ending DACA, the program former President Barack Obama established to protect immigrants who came to the U.S. illegally as children. In September, Mr. Trump said he would end DACA in six months. That end date is now March 5.

The Trump administration said it has appealed the judge’s injunction — which said the Obama-era program must continue for now — to the U.S. Court of Appeals for the 9th Circuit.
But the Justice Department will also petition the Supreme Court later this week to intervene in the case, an unusual action that would allow the government to bypass the 9th Circuit altogether in its bid to phase out the Deferred Action for Childhood Arrivals program starting in March.
“It defies both law and common sense” that a “single district court in San Francisco” had halted the administration’s plans, Attorney General Jeff Sessions said in a statement. “We are now taking the rare step of requesting direct review on the merits of this injunction by the Supreme Court so that this issue may be resolved quickly and fairly for all the parties involved.”
Last week, U.S. District Judge William Alsup in San Francisco issued a temporary injunction halting plans to end the program while a lawsuit challenging the Trump administration’s decision is pending.
