They really ran up the number of charges too. Fifteen felony counts.

I worked for a guy in Collie Fornya whose wife left him for another woman. He secretly recorded - on his own telephone (she hadn't moved out yet) - the two ladies discussing the various possible ways of murdering him. :shock:

But he didn't get arrested, and neither did they. He was simply told that the judge wasn't going to listen to it, and that he couldn't use it as evidence.


When reality is outlawed only outlaws will have reality.

What were actual damages? A trier of fact (judge/jury) can't just award punitive damages. And such damages must bear a reasonable relationship to actual damages. (These days for something like this, maybe 1 or 2 times actual damages.)

I haven't completely absorbed it yet, because the damages were described in different sections in the article.

A federal jury found an anti-abortion cohort led by David Daleiden caused substantial harm to Planned Parenthood by infiltrating abortion industry conferences to secretly tape abortion doctors and staff – and awarded punitive damages of $870,000.
:snippity: The jury also awarded Planned Parenthood and several affiliates roughly $478,000 in compensation for security costs and changes to their vetting procedures. They found the defendants had also conspired to violate the federal Racketeer Influenced and Corrupt Organizations Act, which triples the compensatory damages.

Taking this into consideration, Planned Parenthood is looking at a $2.275 million verdict, which Daleiden’s lawyer Peter Breen said he will challenge on First Amendment grounds, noting that the compensatory damages stem from the publication of the videos.
So punitives were awarded by the jury and were about 1.5 1.8 times the actual compensatory damages (which are tripled to about $1.5 million.)

Yes. As a matter of constitutional law (!) there have to be actual damages to support an award of punitive damages.

And from what SLQ has posted it looks as if those damages may be sufficient to support the punitive damages that were awarded. (It will be close. The compensatory damages are viewed prior to being trebled.)
