MONTGOMERY, Ala., Oct. 15, 2012 /PRNewswire-USNewswire/ -- Today presidential candidate Virgil Goode of the Constitution Party, running as an independent in Alabama, and Hugh McInnish , an Alabama citizen and voter, filed a complaint in Circuit Court in Montgomery (CV 12-1053-R) asking the court to order that Alabama Secretary of State Beth Chapman verify president Barack Obama 's eligibility – and all of the candidates -- to be placed on or remain on the November 6, 2012 general election ballot. In particular, the complaint alleges that there is prima facie evidence that both Obama's birth certificates are fraudulent, and that, under the Supreme Court interpretation, he does not qualify in any event as a "natural born citizen" eligible to be president.The complaint alleges that under the Alabama and U.S. Constitutions the Alabama Secretary of State, having taken an oath to uphold both, must verify Mr. Obama's eligibility; otherwise a fraud could be committed on the American people and votes nullified in the state of Alabama.The Complaint also refers to and incorporates evidence obtained by Sheriff Joe Arpaio and his investigator Mike Zullo , which confirm that the alleged long form birth certificate which was posted on the White House's website is fraudulent. The Complaint demands that the Alabama Secretary of State require that all candidates For President wishing to be on the Alabama ballot produce their birth certificates. Plaintiffs are being represented by two attorneys, Larry Klayman , founder of Judicial Watch and Freedom Watch, in his private capacity (See [/break1]larryklayman.com]www.larryklayman.com), and by Dean Johnson of Huntsville. Soooo.....we get to go through this shit again in Alabama. These effers just do not learn. Once through Alabama would make anyone else abandon all hope. IRR Alabama Law sez something specific about the SOS and "verification" etc.This is another futile, frivolous, and slanderous attack on the Alabama Legal System.

This was the case where we met Mr. Barry Ragsdale, ESQ. IRR he is the State Demo Party Lawyer. He blew them out and took no prisoners until the deferred penalty arose.

Lee explained in detail to Sorensen today why she dismissed his suit, citing the state law that strips courts of jurisdiction over election-related challenges unless another law specifically grants the courts that power.

Yep, we even added a new verb here in his honor. Virgil Goode is about to get "Ragsdaled".Alabama does not have early voting but I imagine absentee ballots are already being mailed.

In which case, the AL AG would have to represent her. It also seems to me that if that is true, some indispensable parties are missing. But hey, what do I know? -xx

Gee willikers. I guess missed the part where the Alabama legislature repealed Alabama Code section 17-16-44 between January and the filing of this suit. I had no idea that Rice v. Chapman, 51 So.3d 281(Ala. 2010), is no longer good law.
