Oh wait! I forgot that at least one Motion to Reconsider and an Emergency Motion to Stay this decision (to preserve the status quo, natch) are mandatory motions at Orlylaw.

Copy obtained and sent on for upload to Jack Ryan's.In the meantime, the short version is "no standing." TWLITHOTU and her co-plaintiff were not parties to the original objection, she isn't a Kansan and has no personal stake, and neither one can "join" an already withdrawn action. Also, too, decisions of the Objections Board are final, and subject to appellate review only in extraordinary circumstances where fraud, etc., on the part of the Board is alleged.Accepting all facts alleged in Plaintiff's application as true along with any inferences that can be reasonably drawn, the Plaintiff's fail to cite one instance of where the Board's acts were induced by bad faith or the result of arbitrary acts showing wrongful conduct amounting to fraud, corruption, or oppression. The Board received Mr. Montgomery's timely objection. They acted in a timely manner on that objection. The objection was withdrawn. The Board obtained additional information and accepted this information even though the objection had been withdrawn. They had no jurisdiction to act regarding any eligibility questions as to President Obama, due to the withdrawal of the objection. These actions are not arbitrary and no specific allegation in the Plaintiff's application as to the Board's actions rise to the level of fraud, corruption, or oppression. Because the Board did not agree with Ms. Taitz, does not mean it acted fraudulently in carrying out its duties. The Plaintiff's application fails to state a claim for injunctive relief.

Wouldya lookee here! What we have is a fine example of a state court judge reading the pleadings and then writing an opinion. Slam, bam, thank you, ma'am! It's all over but the moaning.





This Jayhawker Judge has a lot to learn about how to fuck up a simple bogus ballot challenge appeal. I recommend that he be sent to Indiana for retraining where they'll teach him to hold a hearing without reading the pleadings and then delegate the task of writing the order to the loser.
