I confess I've not paid too much attention to birfer bills this year - they're so "last year" -but I was intrigued by Carl Seel's comment at the CPP that he had a bill in the legislature. Well that's not quite true - no surprise there - Seel has co-sponsored two birferish bills this year:





HB2718 is Judy Burges' latest, its key paragraphs are:


37 D. All persons desiring to become a candidate shall file with the


39nomination paper provided for in subsection A an affidavit UNDER PENALTY OF


39 PERJURY, which shall be printed in a form prescribed by the secretary of


40 state. The affidavit shall include facts sufficient to show that, other than


41 the residency requirement provided in subsection A, the candidate will be


42 qualified at the time of election to hold the office the person seeks AND


43 THAT FOR THE RESIDENCY REQUIREMENT PROVIDED IN SUBSECTION A, THE CANDIDATE IS


44 A QUALIFIED RESIDENT OF THE APPROPRIATE COUNTY, CITY, TOWN, DISTRICT, WARD OR


45 PRECINCT AT THE TIME OF FILING. FOR CANDIDATES FOR PRESIDENT AND


1 VICE-PRESIDENT FROM A POLITICAL PARTY THAT IS ENTITLED TO CONTINUED


2 REPRESENTATION ON THE BALLOT, THE NATIONAL POLITICAL PARTY COMMITTEE FOR EACH


3 OF THOSE CANDIDATES SHALL SUBMIT TO THE SECRETARY OF STATE THE AFFIDAVIT


4 SIGNED UNDER PENALTY OF PERJURY BY THE PRESIDENTIAL AND VICE-PRESIDENTIAL


5 CANDIDATES.and





44 I. ANY QUALIFIED ELECTOR MAY CHALLENGE THE NOMINATION PAPER AND


45 AFFIDAVIT OF A CANDIDATE, INCLUDING THE FACTS OR LEGAL CONCLUSIONS CONTAINED


1 IN THE NOMINATION PAPER AND AFFIDAVIT. THE CHALLENGE SHALL BE MADE AS

What happened to it?- nothing , didn't even get a first reading which I take to indicate that the House leadership doesn't want to go there again.





SB1481 deals with presidential electors and it' key requirement was:





2. An affidavit including facts sufficient to show that the candidate


22 resides in this state and will be qualified at the time of the election to


23 hold the office of presidential elector AND SHALL INCLUDE AN OATH THAT THE


24 CANDIDATE, IF ELECTED AS A PRESIDENTIAL ELECTOR, WILL CAST THE PRESIDENTIAL


25 ELECTOR'S BALLOT ONLY FOR A CANDIDATE WHO IS A NATURAL BORN CITIZEN OF THE


26 UNITED STATES AND WHO WILL BE AT LEAST THIRTY-FIVE YEARS OF AGE ON THE DATE

The bill got refered to Rules Committee and never emerged from it.





The deadline for bill consideration in the house of origin is long past and the deadline consideration in the opposite house is 16th March so it looks as if AZ is going to be boring this year.

Wasn't Seel indignantly posturing at Arpaio's presser that he was leaving the meeting to directly present a new "birther" bill and he assured the press it would pass this time. Gov Brewer won't sign it. She'll find a flaw in it.
