I wish I could say I’m shocked, but I’m not. I’ve lost count of the number of clients I’ve represented who were charged with child pornography offenses. I once attended a CLE in the military where the keynote speaker was an federal prosecutor. He asked, by show of hands, how many of the 450 or so present in the auditorium had represented a military member charged with certain crimes. A few hands went up for murder, more for rape. When he got to child pornography, just about every hand went up.

Is this because child pornography is so common, or because prosecutors overzealously charge?

I could see it either way. I have an old colleague who was arrested and convicted of child pornography a couple of years ago, and he was last person I would have expected to be involved with this. On the other hand, a vacation photograph of my (then) 14 year old daughter in a bathing suit at the beach once caused a co-worker to warn me about having inappropriate images on my work computer.

I don't think this is off topic because there are news reports about some other Florida state level pols who could've been involved. That said, the feds are not charging people with child porn who have a pic of a 14 year old in a bathing suit.

The fact that it appears to be so prevalent is shocking though. I don't know whether it's a function of people who are involved in other bad stuff.

I think I have a vinyl copy (with the album cover) of Led Zeppelin's "Houses of the Holy" out in the garage, somewhere.

Once you've crossed the line with child pornography, nothing is off limits I guess.

Both of those are likely elements, but also, when compared to things like murder/rape/assault, the barrier to entry is much lower with very little immediate negative feedback. While not a passive activity, it is a lot easier to just sorta stumble into then go down a rabbit hole, and it does not take that many files on your computer to get you in trouble. This was a real problem back in the wild days of early file sharing. Though I imagine one of the reasons it is so common in the military are the close social connections and content being traded along trust networks.

Another element is that getting help for such things is both difficult and dangerous. There is this concept that unlike 'normal' people, pedophiles will not be able to control their urges (kinda like how you used to hear about gay people, and still hear about bi males), thus admitting the interest and talking to a therapist comes with the risk of being labeled a rapist waiting to happen.

Get it out of the garage before it ruined by heat and humidity. Unless its one of the rare ones, PLAY IT AND ENJOY!

And even Facebook doesn't ban the cover anymore.

It is extremely common, and I don’t think prosecutors are overcharging. Most of my clients possessed images numbering in the tens of thousands. The ones that only had a few took the pictures themselves.

I haven’t looked at the federal statute in a while (Congress finally got around to amending the UCMJ to include child pornography, so the military no longer charges under the federal statute). But back then you had to possess three or more images (the idea, I think, was that one or two images could be explained as accident, but three...). I think that’s still true, but I’m not positive. And the images had to be a “lascivious exhibition of the genitals,” which was not defined in the statute. So a federal district court came up with a definition (now known as the “Dost factors”), and as far as I know, those factors have been adopted pretty much universally. A picture of your daughter at the beach or kids in a bathtub likely wouldn’t meet the definition. But the Dost factors themselves are problematic (I could write a treatise).

It scares me to think how prevalent this is. I’ve represented lowly enlisted members and senior military officers alike. It’s a pretty easy crime to commit, and people can get away with it if they’re careful (which is how they end up with so many images). But if they’re caught, it’s difficult factually to defend. In most cases the images speak for themselves.

When I was on active duty a guy (O-5) came in all indignant because he thought his right to privacy had been invaded when the military set up a camera in a bull-pen to see who was downloading child pornography on a shared computer. All the military wanted to do was boot him out (he wasn’t yet retirement eligible, but he was close). I was like, Dude, if you fight this, they’ll take you to court-martial and you’ll lose and go to prison, and might have to register as a sex offender depending on your state, but it’s up to you. This guy honestly didn’t see what the big deal was.

Thanks, Maybenaut. Interesting, disturbing and more than a little depressing. I'm guessing O-5s aren't generally stupid, so this guy had to be comfortable enough with his perversion to be so casual about it.

That was in 2003. These days they likely wouldn’t have merely fired him.

Another aide to Matt Gaetz is said to have quit amid an intensifying Justice Department investigation.

https://www.nytimes.com/2021/04/08/us/a ... tw-nytimes
The aide, Devin Murphy, resigned as Mr. Gaetz’s legislative director on Friday. He told associates that he was interested in writing bills, not working at TMZ — equating the work that Mr. Gaetz’s aides were now handling to the tabloid publication, according to one of the people, who all asked not to be identified discussing a sensitive personnel matter.

His departure last week came hours after Mr. Gaetz’s communications director, Luke Ball, also resigned. They were among the most senior members of the congressman’s staff in Washington and their exits suggest that even as he vows to remain in the House, Mr. Gaetz may be facing a hollowing-out of his support team.

Mr. Murphy, who had worked for Mr. Gaetz since he came to Congress in 2017, declined to comment on Thursday, but his LinkedIn page recorded that he left his position this month. The congressman’s office also declined to comment. One of the people who confirmed Mr. Murphy’s departure said the parting had not been contentious.

Erm--this aide had never noticed that Gaetz doesn't do any real legislative work?

Gregg wrote: Thu Apr 08, 2021 9:26 pm He has to finish this term to get a pension, doesn't he? I thought it was 6 years.

Boy, I wish I could have gotten my pension at 38 with 6 years service.

Just like any other employee, Representatives are vested after five years. So, in theory, he could leave in the middle of his third term and collect a small pension, when he is old enough. At his current age, even if he is vested, he probably is not old enough to receive a pension yet, but he could when he is older.

It is a myth that they get their full salary as a pension. Again, just like any other employee, their pension is based on years of service and the average of their three highest earning years.

https://en.wikipedia.org/wiki/Congressional_pension

If I'm reading that Wikipedia article correctly, he will get 1 percent per year of service times the three year average. I believe a base congressional salary is about $154k, so with five years of service, he could collect about $7,700 per year, when he reaches age 62.
