Judge: Do any other defense counsel need to speak?

Ten minute recess to find out. Dear other defense counsel: please recall what Satchel Paige said.

Elizabeth A. Dupuis is up for Centre County Board of Elections.

Centre County's count was live-streamed on the web, she notes.

The complaint points to an unidentified voter receiving a provisional ballot.

"The plaintiff's campaign team was present the entire time... and raised no objections to the process."

We’re back. Two other counsel want to make arguments. One cites the new PA Supreme Court that just came down DURING THIS ARGUMENT finding the things Giuliani complained of are fine under PA law.

Center County admirably ends in about 75 seconds. Lawyer for DNC, an intervenor, is emphasizing some arguments already made. Read the room

The DNC's lawyer Uzoma Nkwonta, from Perkins Coie, is up.

He reiterates a point made earlier by the counties that Trump's co-plaintiffs sued the wrong counties.

They're from Trump-backing Fayette and Lancaster Counties.

They sued seven blue counties, alleging vote denial.

Paraphrase

"If you have a complaint about the election procedure you can bring before the election, then you need to bring it before the election."

"The reason for that rule is so you don't have the conversation about throwing out votes"

NAACP lawyer is up. They’ve left the job of arguing laches to the NAACP and if that’s not the most America thing ever I don’t know what is.

The NAACP attorney is very good, probably as good as Donovan, who handled standing.

Rudy is trying to answer the judge. Not well. He’s claiming the outcome is draconian because the conduct is egregious — the failure to examine ballots. He says mail-in ballots are inherently suspicious and fraudulent. He says inspecting ballots is fundamental to elections.

Giuliani's line was barely audible in his initial answer.

Eventually, he audibly calls the alleged conduct "egregious."

"We're not asking for the entire vote to be canceled," he says, before seemingly asking yet again for just that.

Giuliani:

"Those two men lost their right to vote," referring to his individual clients, who are residents of Fayette and Lancaster, whom he did not sue.

Giuliani says his clients' counties did nothing wrong.

Another federal judge rejected the notion that the other counties did anything wrong, either.

Giuliani also taking issue with some of the criticism he faced during the hearing, says he feels "aggrieved by them misrepresenting what I said" after they said the ballot observing claims were struck from the complaint (which they were).

I really don't get the logic here.

Giuliani says he is "aggrieved" by opposing counsel saying the complaint doesn't include allegations about observer access, and repeats language in the complaint referring to it. But he doesn't engage with the fact that they cut the specific counts related to that issue

Giuliani argues that they've preserved the observer issue because the equal protection count (which specifically addresses the notice/cure issue) also has a line that says it incorporates everything else above in the complaint
