Defense is now citing cases for the proposition that alleged violations of STATE elections law -- even by state actors, let alone by unidentified randos -- do not rise to the level of federal constitutional violations federal courts can hear.

Donovan is back up, fighting against Giuliani's arguments of equal protection violations. He cites another federal case in Pa on dropboxes, where a judge rejected equal protection claims.

He also cites other court rulings, at the Fifth Circuit and in Nevada, that found that one county making it easier for people to vote doesn't dilute the votes of people in other counties.

New defense lawyer argues abstention issues. This lawyer is remote rather than in the courtroom.

What's abstention? It's a doctrine that says federal courts should stay out of certain state disputes. There are different types of abstention, each with tedious names.

Aronchick says the pictures that Giuliani is "waving around" today are "irrelevant" because of the Supreme Court's opinion, which he says he does not believe Giuliani read.

Aronchick says there Giuliani is turning the equal protection clause "upside down," arguing that making ballot-access easier violates their rights.

If some counties do a poorer judge of ballot-access, Aronchick says: "We don't race to the bottom now."

After a little more than an hour, the session was interrupted because of the failure of phone lines the court had set up for the media and the public to listen in.

The hearing in this city of about 28,000 residents, about an hour and a half drive north of the capital, Harrisburg, drew a raucous crowd of Trump supporters, who chanted, prayed and sang before and during the court session. Cries of “Stop the steal!” ”Dead people can’t vote!” and “Four more years!” went on for hours, occasionally punctuated by honking horns from passersby in this solidly red county, where voters went for Trump over Biden, 70 percent to 29 percent.

Aronchik is standing for all of us laughing at Rudy's insane claims. "This is disgraceful" Aronchik says.

I see there's some discussion about whether Aronchik is being too harsh on Rudy. It's harsh, but I don't think it crosses a line. Someone has to say on that side this is crazy.

Lawyers have different styles. And some righteous anger sometimes is important. I don't have a beef with it.

You also have to remember: I'm told this is a very prominent local lawyer. He likely knows the judge and knows how far to go.

I've no inside info. But that is a thing.

Aronchick says Giuliani has no way of knowing the ballots that they say are at issue would swing the results for Trump. He gets worked up again, saying Giuliani's suggestion that more than 1M ballots should be tossed is "disgraceful"

While I have tons of respect for Ken White, and while it is important not to step over the line in court, I tend to agree with Melkonian here. My personal style involves bringing a controlled amount of righteous anger to the courtroom when called for. If the other side is doing something ridiculous and unconscionable, I'm going to say so, and I'm going to say so without mincing words. Partly that's because I occasionally practice in front of judges who are a bit thick and don't tend to recognize subtler approaches, and partly it's because my personality (as some of you might possibly have noticed) has been known to tend towards irascibility from time to time, and sometimes I just can't help myself.

And the judge asks Aronchick ("with no disrespect") to try moving around less because his connection is breaking up. the judge notes that he is sitting "quite still," and suggests the lawyer could "model" that behavior.

He notes that the case hast turned "for some reason" into some sort of "lifeline" for the Trump campaign.
