What about the part where he said "This undoubtedly began with Berg tattling on Orly." How else would the judge have learned that the $4,000 Oxy sanction existed?That's a good question, but I don't think we have enough information to conclude that Berg is the only possible answer.

We seem to be focusing on parsing the meaning of "discovery sanctions" and how it might apply to this case, but what Judge Guilford wrote was that "ome evidence has been presented to the Court that the sanction involved far more than discovery."
