Re: AsystBio LLC case

Have you ever considered the possibility that I really am as smart as I think I am? Or that you might be wrong in this case? There's an Oliver Cromwell quote - one which, I believe, has been transposed into a Bayesian maxim of sorts - that seems apropos: "I beseech you in the bowels of Christ, thin...

Re: Judges Behaving Badly

Bad guy or 1st Amendment? Hard to say without really looking at the full opinion (which I lack both the time and inclination to do right now; we're in the middle of moving house at the moment), but I suspect it's a mix - but one tilted more toward the "bad guy" side. On the one hand, this is a stat...

I'm no fan of Assange. But some of those charges do seem a bit concerning. Ability to try and convict, overreach, First Amendment? First Amendment. While I personally don't think Assange is a journalist, I think society is better off with a definition of journalist that is very broad, particularly ...

Mike, by "we," I take it you are referring to normal people, not Trump voters.
Society as a whole, really.

Sadly, though, it's not just Trump voters anymore. There's been a depressing amount of cackling glee on Twitter over the whole Garland's court getting the appeal thing.

Re: Oversight/Intel Committees: Allen Weisselberg Testimony, Trump Org CFO; Mazars USA; Re Financial Records

Merrick Garland is the chief judge of the DC circuit. The appeal will be heard by a 3-judge panel, which could include Garland. I read that somewhere yesterday. Not sure where, but it makes sense. I guess Garland has the sensivity to recuse himself, especially after the media eposure. Can you imagi...

Re: Congressional Committees: 2019 New Russia Investigation, Trump Finances

So will Ramos' decision be appealed to SCOTUS? Or is this mostly the end? Both. The two decisions will both be appealed. But even if I ratchet my skepticism up as high as possible to account for the current SCOTUS, it's still very hard to find a serious legal question here. The legislature has very...

Based on the CA indictment, it seems likely that he was lying and cheating well before the Kimberly Clark verdict came in - so I suspect that even if the verdict was upheld in full,* the plaintiffs there would just have been added to the victim list.

*Which clearly wasn't going to happen.

Depends. To the extent that "not behaving badly" qualifies as "behaving well," sure.

To the extent that we think of statements that are reasonably supported but simply don't fit with the current hyperpartisan environment as being worthy of special praise, I think we've lowered the bar too far.

tl:dr - lots of issues of first impression; the anti-BDS legislation could easily be the core of a con law final (and probably has been). Procurement law is detailed enough to be its own specialty (with its own subspecialties), and it frequently does not give governments much leeway when it comes to...

Re: President Trump

I don't think that's impossible. But I do think that Iran is perfectly capable of setting themselves up, too - especially if they don't have perfect control over all their surrogates.

And they might not see a conflict with the USA as entirely a bad thing at this point.
