Re: 2020 Election Lawsuits

Marc E. Elias @marceelias · 5m NEW: We have filed our opposition to Trump's 3rd Circuit appeal of his loss in Pennsylvania federal court. https://www.democracydocket.com/wp-content/uploads/sites/45/2020/11/Document-2.pdf Lol. In this brief, they go to great effort to avoid saying Guiliani's name. :...

Re: 2020 Election Lawsuits

Random thoughts. I still don't understand how the individual plaintiffs have stated a claim against the defendants in the second amended complaint. This brief makes no attempt to outline how the second amended complaint gives anyone standing under the analysis laid down by Judge Brann or address ho...

Re: 2020 Election Lawsuits

Let's pretend that the Appellate Court sends it back to Judge Brann with instructions to allow leave to amend the complaint. I guess they could throw in some allegations to shore up their standing, although I think they might be stuck with the proposed complaint they submitted with the motion. Even...

Also, experienced lawyers are chortling on twitter that if DT wins on the narrow issue of right to amend, he has forfeited the other legal issues (standing, redressability, that he could have raised on the this appeal, and can't raise them in the court of appeals if he loses on them a second time i...

Re: #Q #QAnon "The Storm” "Any Day Now" - Conspiracy Theories For Dummies: "The Mental Gonorrhea of Conspiracy Theories"

I remember one time they actually put some monkeys in a room with some word processes as an experiment. After a week the room was a shambles and the monkeys had been using a keyboard as toilet. Not one word of usable language was detected. That was the essence of birtherreport.com, as I recall. :ro...

Re: 2020 Election Lawsuits

So Trump is dropping this case because “Wayne County ... declined to certify”.

Except they did certify, and the subsequent pressure on the two Rs has exposed them to perjury charges.
Except one of them is now trying to rescind that certification. :madguy:

Partly because she's doing "okay" and partly because of new Covid restrictions, the princess is being discharged to home this afternoon.

There will be some changes for her (and me) and she will be closely monitored by a team. Hopefully, she'll do well.

Nah. He's making sure the record is complete. Obviously not going to argue with you but I don't think that's necessary in this case. What's their appeal argument going to otherwise be, that the judge didn't let us convert to an injunction, just granted the MTD? Just sayin'. :bighug: I was wat...

Re: 2020 Election Lawsuits

I’ve read that Rudy doesn’t care whether or not he wins this case, since his only objective is for SCOTUS to hear it and of course, to rule in his favor. Could SCOTUS accept this (or any other of the cases) on a ‘just because’ basis, or does there actually have to be a legal reason? I’m under the i...

Re: 2020 Election Lawsuits

I can't believe this is simply argument for a Motion to Dismiss. Join the club. People get their initial exposures to legal proceedings under the worst of circumstances. But Judge Brann is happy to let them all run wild. He was indeed and now essentially converting this failed MtD to a injunction.
