Re: DNC v. Russia [& Trump, Wikileaks, etc., re: 2016 election] (S.D.N.Y.)

I've been on a plane for the last three hours. Did the pilot slide through a dimensional warp and into a timeline where the DNC is a lunatic pro se plaintiff? Close. The DNC found a lawyer to file this glop. Who decided to tell those of us who were asleep since 2016 what was happening in a Hollywoo...

We use the term "moran," which indicates a violuntary decision to ignore facts and do stoopid things to satisfy yo...

What's the over/under on whether or not Orly has sent a letter to Trump, offering her services, in light of his reported difficulties finding a lawyer who will take the case? After all, she is the country's most renowned Constitutional lawyer. She just needs a little help getting pro hac vice statu...

It includes a garbage "Introduction" which moralizes and tells a story. Pathetic. If you're serious about filing a lawsuit, make the short plain statement contemplated by Rule 8(a)(2), F.R.Civ.P., which requires that a "pleading that states a claim for relief must contain . . . a short and plain sta...

Re: Mueller's investigation of Trump

The Listserve list mentions Ford's pardon of draft dodgers as the most controversial and then says this, which I know from personal, professional experience, is absolutely incorrect: The pardon was also criticized by those who believed that it didn’t go far enough. While the pardon was unconditional...

Mr. Trump made the call seeking advice from Jay Goldberg, who represented Mr. Trump in the 1990s and early 2000s. Mr. Goldberg said he cautioned the president not to trust Mr. Cohen. On a scale of 100 to 1, where 100 is fully protecting the president, Mr. Cohen “isn’t even a 1,” he said he told Mr....

Re: Mueller's investigation of Trump

Also, wondering when jeopardy kicks in -- if Trump pardons someone *before* they are indicted (because he jumps the gun in panic, say) -- then has initial jeopardy even taken place for there to be double jeopardy? Aside from the Richard Nixon/Gerald Ford situation, which is sui generis , generally ...

Re: Abuse of the Pardon Prevention Act - 2018

So a criminal president can pardon his partners in crime, while his shameless lackeys in Congress protect them by blocking impeachment (or at any rate, removal)? And meanwhile his lap-dog 'news' media are telling everyone "nothing to see here?" The Founders never imagined anything like Trumpism. I ...

"This was beyond free speech. This was disrespectful," Castro said.
Yes, because the only allowed free speech is respectful free speech. Which is why we don't even need a constitutional provision guaranteeing free speech. As for disrespectful speech, it is prohibited.

Small point: A lawyer does not "file a TRO" which both the news article and a Fogbowzer have written. One files an application or a motion for a TRO. If a TRO is granted, the court or the clerk files it.

Re: Stephanie Clifford aka Stormy Daniels v Donald J. Trump aka David Dennison, U.S. District Court, Central California

Sounds like the Chin would be filing the defamation claim on behalf of Stormy against PPOTUS. And Stormy is now a public figure, too. But it would also depend where it is filed. If in California it would be quickly stricken. In other states with weaker or no anti-SLAPP statutes, it could take longe...

During his election campaign the voters can be told Kobach cost them money. It being Kansas, they probably won't care.
