I don’t know what his status is. If he’s already been separated from the military, they no longer have jurisdiction. Once they put you all the way out, they can’t pull you back in for court-martial. If Pemberton was on active duty when he committed his crime can't he also be prosecuted by the military ? A 25 to life sentence would be appropriate under the circumstances.
