The problem is that there is no way to force a Supreme Court Justice to recuse themselves. The ethical and honest ones do (See, e.g. Kagan, Elena) but the others don't (See, e.g. Alito, Samuel; Thomas, Clarence). Kavanasty is neither ethical nor honest and he won't recuse himself, like ever.
