One hell of a good lawyer, particularly on absolutely anything even remotely connected with immigration policy.

Re: USA v Roger J. Stone, Jr., USDC-DC, Obstruction, False Statements, Witness Tampering
I concur: the OSC hearing will likely result in some stern words, the apology shuffle, and an expansion of the gag order. And a warning to bring his toothbrush if the need to discuss the order arises again. I think that's probably right - as of today. But Stone has 48 hours before the hearing, whic...

There's lots and lots of cases that say you can't conflict out the judge through your on misconduct.

I've got the full draft now; will be reading it over next day or two and (I'm sure) talking with others in my program. But first impression is that it's pretty damn bad.

Yes, this is what i need to do. One problem I do face is page limits. He always throws so much BS that it's time consuming and tedious to point it all out. But y'all have given me some great ideas. Yeah, the Gish Gallop isn't just confined to oral debates. Exactly. I actually cited some authority a...

Calling opposing counsel a liar is counterproductive. Restate the opposition's claim. Then quote and cite the evidence that refutes the claim. Trust the reader to conclude that opposing counsel lied. Yes, this is what i need to do. One problem I do face is page limits. He always throws so much BS t...

The makers of the video were assholes. But if the video itself is not fair use, neither was the mashup music video featuring AOC that was in the news at the beginning of the year.* *And it may not be fair use, at least under current law, because the courts have concocted a doctrine that treats "paro...

Would you mind if I use the "Question" portion of this with my moot court team? We're working toward oral rounds for a major moot, and I've been trying to get them to see the importance of framing an argument. I think showing them that would help with a couple of points along those lines I've been s...

Article 13/EU Copyright
It will be another week or so before I am able to sit down and fully work through the latest draft of the EU copyright directive, so this should largely serve as a placeholder for the moment. However, given timelines and the possibility that our EU readers might wish to contact their MEPs, my prelim...

I suspect that the current Supreme Court will, if they grant cert, rule that the bans are "stupid but constitutional." (Or equivalent language.)

I suspect that, even given the high bar on proof of collusion in the CBA, just the fact that a quarterback of his talent did not receive even one lowball offer from a bottom-of-the-league team would go a long way toward making that showing - the evidence of his skill isn't admissible under the CBA b...

Even ignoring a NEPA evaluation, there are fundamental Geotechnical and civil engineering assessments that need to be done first. What's the over under on when the first lawsuit is filed? Close of business today? Better to wait a few days for more details. I think the ACLU's timeline is more approp...

Funny thing about court dockets. "Withdrawn" filings don't actually get taken off the docket or removed from public view. There's just a subsequent entry saying that the filing has been withdrawn.

I haven't made one since the one Stern hosted. Don't think this will be an exception to my streak of missing events - what with bouncing back and forth between US and UK several times a year, most of my travel budget is pretty locked in. And (shockingly) it turns out that a PhD involves a metric shi...

It brought me joy to see your post Stern, always thinking of you! I saw Avenatti as a ballsy temporary distraction that reminded voters what a lying conman Donald is. Mike Dunford has laid out some serious specific issues and if true, he deserves to pay the penalty. I'm disappointed but was never i...

Not surprised that the copyright office denied registration, but it's also not something that's immediately fatal to the copyright claim - the copyright office's determination isn't binding on the court, and I can think of at least one case just off the top of my head where the court found that an i...
