Re: Larry Klayman

I assume the nominal plaintiffs are pro per so Klayman can ghostwrite for them once he's officially suspended. An individual can be pro per, but not if she's a class-action plaintiff, because that means, by definition, she's representing others. So only someone represented by a lawyer can file a cl...

Re: Orly's latest poopies.....

That be true, Taitz. However, some Real Lawyers know how to file for a restraining order and this would be stretched out beyond Trump's term of office. Taitz's comment is absolutely not true. The Court ruled that DACA can be reversed only through notice-and-comment rulemaking, which can't possibly ...

Klayman says he may try to refile in state court ("in Florida, where Laura and I are citizens").
Can you say, "res judicata," boys and girls?

I knew you could!

What is the difference between the General Bar Exam and the Attorney's exam. IANAL, but I thought that by passing the Bar Exam (and meeting all the other requirements), that one more or less automatically became an Attorney. Things may have changed since I joined the California Bar, :geezertowel: b...

Re: CHRISTOPHER BRUCE: The Mighty Spork

The phrase "without prejudice" has a number of different meanings in U.S. law, somewhat different from each other depending on the context. And it has yet another meaning in U.K. law, not used in the U.S. (In the U.K., it refers to settlement discussions.) The reference to UCC 1-308 which often acco...

But don't be surprised if several readers start asking for your lasagna recipe!
When the coronavirus panic first hit, I went into my local Whole Foods, and the found the entire pasta aisle bare-- except for lasagna. I think a lot of people could use that recipe.

Re: Larry Klayman

Curious if either defendant will remove to federal court.
Not removable. The defendants have been sued in their home venue, so cannot remove based on diversity. 28 U.S.C. 1441(b)(2).
