Whether it’s a felony or not is determined by the maximum possible punishment, not the sentence actually handed down. So this was a felony conviction.

Re: Bundy Ranch Trial #2--The Big One: Cliven, Ammon, cRyan, Ryan Payne, Pete Santilli

Now Ryan gets to stay with a relative? I preferred the halfway house. Here's hoping he wears out his welcome. It sounds to me like they're trying to litigate water rights, desert tortoise protections, and law enforcement. NONE of which is relevant to the Bundy threat. I thought Navarro pointedly sa...

Re: Hijack this thread

Sometimes the kneejerk reaction is to deny the claim to see if you’ll go away. Perhaps you can push back - ask to talk to someone higher up.

Is the failure of a sump pump an act of God? Asking for a friend.

Oh, for the love of Mike. Doesn’t he know you’re supposed to take the tailor’s tag off the sleeve before you wear the suit in public? When you don’t you just look stupid.

Re: Hijack this thread

Our social rules need to be regularly exercised to teach people and enforce our social expectations that some things are out of bounds. Not everyone is in a position to call out an offender at the time the offense occurs, but those who can, should. :yeah: This is so, so fraught. What I hope comes o...

Regarding Sen. Franken's statement: I think this is as good an apology as I've seen. He's owning what he did, saying it was wrong, not trying to explain it away.
And inviting an ethics investigation.

Re: Democrats Behaving Badly

Like many USO shows before and since, the skits were full of sexual innuendo geared toward a young, male audience. Having been voluntold to attend more than one of these*, I'm not surprised. Not that it excuses Franken's conduct any, but I think it's time the USO put a stop to this sort of entertai...

Question about this recent twist on the video feed (or whatever the proper word for it is). Is this something the FBI did and never told the prosecution? Or did the prosecution know about it and never offered it up? Assuming there was a Brady violation, it doesn’t really matter. The court doesn’t l...

Re: Bundy Ranch Trial #2--The Big One: Cliven, Ammon, cRyan, Ryan Payne, Pete Santilli

Well, I meant the actual people they bought the ranch from. In the context of a "lie" told by an attorney in an opening statement, this doesn't strike me as something that's easily proven to be false without engaging in a significant genealogical research. I doubt any court or bar would fault an at...

Re: Bundy Ranch Trial #2--The Big One: Cliven, Ammon, cRyan, Ryan Payne, Pete Santilli

The specific instance we are talking about here are Whipple's statement(s) about the history of Bundy Ranch. Those statements, presented to the jury, are demonstrably, indisputably, false . The Bundys bought the land in 1947, not 1877. That is just one example of Whipple's mischaracterization, to p...

:snippity: Well, it is not acceptable to lie in court. A lawyer has a duty of “candor to the tribunal.” But when the facts are subject to interpretation, then it’s probably not a lie. For example, if the government seeks to prove that the defendant intended X, and the lawyer gets up and says no, th...

:snippity: The jury isn't going to know the facts are questionable (and then some). Am I understanding correctly that it's acceptable for an attorney to lie outright in court during representation? I've wondered about that, too. IAALs care to chime in :?: Well, it is not acceptable to lie in court....

Re: Louis CK, Sexual Harasser AND Man of Integrity

Whether a person "has integrity" is such a complex (and loaded) question. Arguably, a person with any "integrity" wouldn't do these things in the first place, and the quality, scope, and reasons behind any subsequent apology are therefore meaningless. But I don't really give a shit whether Louis CK ...

Has the judge ruled on Ammon's motion for pretrial release yet? No - that is to be discussed in court after lunch break. Thanks -- wasn't sure I missed it. I, for one, don't necessarily think he's a flight risk as much as he is a risk to commit further misconduct (as in, more standoffs), and put th...

If he loses, the GOPs lose a seat in the Senate, but that’s neither good nor bad for the party, IMO. He can damage the party if he wins, though. A lot. Like Mike said, he’ll make the most out of the national forum, but in the end whatever he does will hurt rather than help the party. Even so, I stil...

Remember, New Jersey voted for the Republican Governor twice just 4 years ago and 8 years ago, yet this time they voted for the Democrat by a big margin. The same is true in Virginia. I'm a bit surprised. Usually it rolls uphill just a bit in cases like this. I've heard nothing about the commanding officer. According to the Washington post, a couple of officers in the chain of command have been relieved of command over this. https://www.washingtonpost.com/news/checkpoint/wp/2016...
