Re: Michael Avenatti

Nothing personal to the person who posted that, but how is there probable cause, if the arrestee was not possibly even there? "My husband hit me! When I started to the call the police, he fled!" Etc. I realize the constitutionality of this has probably already been tested, especially in a litigious...

Re: Michael Avenatti

Nothing personal to the person who posted that, but how is there probable cause, if the arrestee was not possibly even there? I didn't take it personally. I can certainly see why a person might think there's not probable cause in the scenario Sugar Magnolia described. But I can also see why a cop u...

Re: Michael Avenatti

I believe it. The section of the MS Code of Criminal Procedure dealing with warrantless arrests uses terms like "may arrest" for certain crimes, but says "shall arrest" with respect to domestic violence. The law gives the officer some discretion with respect to whether there is probable cause, but I...

Re: Michael Avenatti

There was an article about this sort of false report of domestic violence in today's Washington Post. Woman accused her ex-boyfriend of DV, but he was able to prove he was elsewhere because he was lucky enough to be with family members taking selfies at the time of the alleged incident. If he was h...

Re: Michael Avenatti

Not sure that we can really trust any of the details reported by TMZ. I think the only detail that is straightforward and undisputed is that the LAPD confirmed that he was actually arrested for felony domestic violence. Which is interesting, because it wasn't his ex-wife, we assume it wasn't any of...

Re: Michael Avenatti

so, on the TMZ story it says: 4:50 PM PT -- Law enforcement sources tell TMZ, the LAPD has already obtained an emergency protective order, prohibiting Avenatti from going near the alleged victim. We're told they will serve him with the legal docs before he's released from custody. We're told he wil...

Re: Michael Avenatti

Slate sums up my entire position better than I have across many posts (see the article for a whole lot of links): That would be more informative if it contained a single fact about this incident. But it doesn't. Just a lot of frothing and vituperation about incidents that are old news. I thought FR...

Re: Mueller's investigation

I don't disagree with any of that. I'm just saying that while we may not have an Official Secrets Act, nor do we have a blanket prohibition on criminalizing publication of certain classified information.

Re: Mueller's investigation

Well, the United States doesn't have an Official Secrets Act. Journalists can't be jailed for publishing things that are classified. That is not entirely accurate. 18 USC Sec. 794(b) criminalizes the publication of information relating to the distribution of the armed forces in time of war. Sec. 79...

Re: Mueller's investigation

Governments keep things secret for a reason. Sometimes those things should see the light of day, and sometimes they shouldn’t. But I think it’s dangerous to let the people willing to steal the information be the arbiter of what is made public. I’ve said this before, and I’ll say it again. The ends ...

What is "due process" for revoking Acosta's hard pass? I doubt the White House wants to charge him with a crime.
They have to follow the requirements of the Administrative Procedure Act.

Re: Mueller's investigation

There was a time when I would have agreed that Wikileaks was some form of journalistic enterprise. That changed around the time of the "Collateral Murder" release, when they went from simply serving as a clearinghouse for leaked information (which was an extremely valuable public service) and start...

Dog bite saga - update Completed the course of rabies vaccinations. I feel very fortunate not to have had any adverse reactions to the injections. To say nothing of the fact that I can't recall off the top of my head litigation before a federal court over the issue of an executive appointment since Marbury v. Madison . Re: I Voted 2018! Voter Check In, Election Watch and Poll Conditions

Done! I did go against the party on a constitutional amendment. The question was whether there should be a partial tax exemption for real property subject to recurring flooding so long as there is flood abatement in place. I have mixed feelings about it, but in the end I said no. In the decades to c...
