Is income tax evasion one of the charges? How could he owe massive back taxes, yet not be guilty of tax evasion? Well, the jury could nullify. And IIRC, tax evasion requires intent. If the jury acquits because they didn’t think the govt proved he intended to evade, he’d still owe the taxes. Correct...

Question for the criminal lawyers here. As an acquittal isn't appealable by the prosecution, can, and should, the prosecution ask for a mistrial now based on the Judge's behavior and, if necessary, take an immediate appeal upon Ellis' inevitable denial? They'd lose. The only way the government wins...

IANAL and I have no experience at being a juror, but reading this thread makes me wonder if sometimes the judges are more concerned about the jury than the defense/prosecution.
