Re: I HATE HOSPITALS AND SURGERIES, BUT ... Gonna Be Putting up With Both For a Few Days

Because everything I do I do slightly wrong I managed to find a sleeping lounge in the icu to get some rest. It even had a shower. Which was wonderful except I managed to place my clothes on the sink while showering and the place I put my clothes was right under the automated soap machine so while ...

Come on people! Walt IS a loser. He's a convicted FELON. In my book, that makes him DANGEROUS. Full stop. I don’t think anyone is saying Walt isn’t any of those things. I’m certainly not, and if I left anyone with that impression in my defense of the hundreds of servicemembers who get passed over e...

I will defer to Maybe's superior knowledge.

FitzFundFilcher is still, however, a consummate asshole. And that's about the nicest thing I can say about him.
I do not disagree.

I would guess its the same in any kind of hierarchical structure, and it engenders the same resentments. When I was in the Priestly college I heard a story of one of the class lecturers who one day just went on a rant about who was selected for Bishops and who wasn't, and he said that people who di...

Maybe, I'm not mocking FitzFundFilcher for retiring as an O-4 but for continuing to claim he was an O-5. ( OTOH an almost 20-year Annapolis grad who retires O-4 usually has something wrong in his personnel jacket . As Fitzy had.) I disagree with this. After I retired from the military I spent a lot...

Did Walter ever serve on the Indianapolis ? No; Fitzpatrick was attending a reunion of the survivors of the Indianpolis that sunk in World War Two (as portrayed in the Nick Cage movie ). I don't begrudge Fitzpatrick's honoring other Navy vets. I don’t either. My biggest criticism of Fitzpatrick as ...

Cedar Bayou near our house is up 1 1/2 feet since my last report. It will begin flooding if it rises 1 1/2 more feet.

Houston Bush Airport has reopened but most of the roads around it are floodied.

Not really a fan of either. JAG was one of those shows where they were so wrong on the law that it is painful to watch. When I was on active duty, during our obligatory ethics training there would always be snippets from the show. It was a veritable treasure trove of examples of unethical conduct c...

Not me. Most of our cases are losers. But in our system appeal is automatic, so you do what you can without crossing the line into frivolousness. I have to ask if you were a fan of JAG? I have been recording and watching reruns since WGN started airing the series in the afternoons. I had forgotten ...

I went to a CLE once featuring a panel discussion with the judges from the Court where I regularly practice. The question about the utility of oral argument was posed, and one of the judges said something like, “maybe you’ll convince us and maybe you won’t. But if you treat the argument as a speed ...

The Informant by Kurt Eichenwald. Non-fiction. About an FBI sting involving price-fixing at Archer Daniels Midland in the early 1990s. The story is just bizarre. Dude goes to the FBI to report price fixing, agrees to become a cooperating witness all wired up. And while he’s doing that, he embezzles...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

I can tell how an appellate panel is going to decide no later than the first question. When it comes to SCOTUS most of us can tell when the Court grants cert. The art of appellate advocacy is overblown. The only place where argument is of any utility these days is closing argument to the jury. I do...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

I've always thought that most appellate court argument is just theater. The judges usually have read the papers, have bench briefs from their clerks and know where they want to go. In my view it's rare to turn around an appellate judge who has made up her mind, and most have before oral argument. T...

Congrats! Appellate argument is nerve-wracking even when you have the law and facts on your side. Because you just never know. As an advocate, all you can do is tell the Court what you think - you can’t make them agree with you. So it is such a relief when they do because there is always that little...
