Re: ~~»» HAPPY BIRTHDAY FOGBOW! (we're 10 yrs old) ««~~

I’m getting a little misty-eyed. I’m nostalgic for the days when folks were commenting on Orly Taitz’s web page using character names from All My Children. Or in acrostics mentioning The Fogbow. Good times.

Re: State of Wisconsin vs. Kyle Howard Rittenhouse

I don’t think clean/unclean hands is a thing in criminal law. At least it’s not a thing where I practice. I think it has to do with trying to collect when you are responsible for your loss by fraud or misrepresentation or something like lat (but law school and the bar exam were a long time ago).

Re: Hijack this thread

well, it has happened. I've gotten to the point where I pretty much can't watch the news any more. It seems we've reached the point where there is about 1% actual content, and the rest is one person or another putting their spin on the same old stuff. Commentators who provide insight, I can watch. ...

Re: Bowe Bergdahl - IS Charged With Desertion

Awhile back Colonel Vance Spath, the military judge presiding over the military commissions in Guantanamo Bay, was preparing for retirement and was applying to be a federal immigration judge. He didn't tell any of the parties that he was doing that, so they didn't get an opportunity to challenge him...

I don't know if the initial reason for the doctor performing these are to intentionally sterilize based in wanted to reduce procreation. It could be more a matter of the doctor wanting to pad his wallet knowing the for-profit prison and ICE will not question the bills if it has paperwork documentin...

Re: Joseph Scott Pemberton

If Pemberton was on active duty when he committed his crime can't he also be prosecuted by the military? A 25 to life sentence would be appropriate under the circumstances. Depends on what they charge him with. If he's charged with premeditated murder (unlikely) or murder during the commission of c...

I don’t know what his status is. If he’s already been separated from the military, they no longer have jurisdiction. Once they put you all the way out, they can’t pull you back in for court-martial. If they kept him on the books, even in a no-pay status, they retain jurisdiction. But they have to s...

Re: Investigations in New York State of Trump and Related

I don't think the Westfall Act is crappy in itself. It was designed to protect federal employees who commit acts of negligence while on the government clock. What is crappy is how the DOJ is now using it. Why do negligent people need protection? What about their victims? It only means that the gove...
